The settlement includes anyone in the United States who purchased Deep River-brand potato chips labeled with a “Non-GMO Ingredients” graphic between February 2, 2017, and December 6, 2024.
How Much Can You Receive?
Settlement payouts depend on whether you have proof of purchase:
With Proof of Purchase: $5 for the first product and $0.50 for each additional product. No limit applies if you provide receipts for each product.
Without Proof of Purchase: $5 for the first product and $0.50 for up to 10 additional products (maximum of $10 total).
Combined Claims: If you claim some purchases with proof and others without, both will be considered and combined for your payout.
About
If you purchased Deep River potato chips in recent years, you may be eligible for a cash payout thanks to a newly approved class action settlement.
The lawsuit alleges that Old Lyme Gourmet Co. (dba Deep River Snacks) misleadingly labeled its chip packaging with a “Non-GMO Ingredients” graphic, implying third-party certification that the chips were free from genetically modified organisms. Plaintiffs argued this led consumers to believe the products were certified by organizations like the Non-GMO Project—when they weren’t.
