Background

What happened

Bimbo Bakeries USA, Inc. determined on December 6, 2025 that a previously unknown, or "zero-day," vulnerability in Oracle's E-Business Suite application had allowed an unauthorized party to obtain files stored in that application. According to the notice filed with the California Attorney General on September 4, 2026, the company applied Oracle's patches once they were released and retained specialists to determine which files had been accessed.

The company states that it completed its review on August 19, 2026 and began mailing notification letters on or around August 31, 2026, roughly nine months after the incident was discovered. The regulatory filings report that at least one affected file contained names, Social Security numbers, financial account information, and credit or debit card numbers belonging to current or former stakeholders. Bimbo Bakeries USA is offering 12 months of complimentary single-bureau credit monitoring, credit report, and credit score services through Cyberscout, a TransUnion company.

Social Security numbers combined with financial account and payment card data are among the most sensitive categories of information a company can hold, and they carry a long-term risk of identity theft and financial fraud that does not expire when a monitoring period ends. Whether the company's security practices and vendor oversight were adequate, and whether the roughly nine-month gap between discovery and notification caused additional harm, are among the issues being evaluated.

What to do if you received a letter

1

Keep your notice letter

Do not discard it. Your letter contains the enrollment code for credit monitoring and is important evidence if you decide to participate in a lawsuit.

2

Enroll in the free 12-month credit monitoring

Enroll in the Cyberscout (TransUnion) monitoring offered in your letter before the deadline printed on it, which is generally 90 days from the date of the letter. Accepting this benefit does not waive your right to pursue legal action.

3

Place a fraud alert or credit freeze

Contact Equifax, Experian, and TransUnion to place a fraud alert or freeze on your file. Request a free weekly credit report from AnnualCreditReport.com, and use the FTC's IdentityTheft.gov recovery guide. Because the notices report that financial account and payment card information was involved, also review bank and card statements line by line and consider asking your bank to reissue affected cards.

4

FAQ

Common questions

I received a data breach letter from Bimbo Bakeries USA. What should I do? +

Keep the letter, enroll in the free 12-month Cyberscout credit monitoring before the deadline printed in your notice, place a fraud alert on your credit file, and watch your bank and card statements closely. Because the filings report that Social Security numbers, financial account information, and card numbers were involved, you may also want to consider a credit freeze. Contacting a data breach attorney for a free consultation does not affect your right to accept the monitoring.

Am I eligible to join a class action against Bimbo Bakeries USA? +

If you received an August 2026 breach notice from Bimbo Bakeries USA, you are likely eligible for a free case evaluation. Eligibility depends on your state of residence, the categories of your data that were involved, and any losses you have suffered. Dapeer Law will review your notice at no cost.

How much money could I receive from a class action lawsuit? +

Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.

What personal information was exposed in the breach? +

The regulatory filings state that at least one affected file contained names, Social Security numbers, financial account information, and credit or debit card numbers. The sample notice letters themselves describe names and Social Security numbers. Your individual letter should specify the categories of your data that were involved, so check it carefully and keep a copy.

Did Bimbo Bakeries USA offer free credit monitoring? +

Yes. Bimbo Bakeries USA is providing 12 months of complimentary single-bureau credit monitoring, credit report, and credit score services through Cyberscout, a TransUnion company, along with fraud assistance. Enrollment generally must be completed within 90 days of the date of your letter. Enrolling is separate from, and does not waive, your right to pursue a claim.

How many people were affected by the Bimbo Bakeries USA breach? +

State regulatory filings reviewed so far report 4,345 individuals, including 3,982 in Texas and 363 in Massachusetts. A nationwide total has not been published. This page will be updated as additional filings become available.

Is there a deadline to take legal action? +

Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.

How do I get a copy of the official breach notice? +
