The Devereux Foundation Data Breach Lawsuit Investigation

Dapeer Law, P.A. is investigating a potential class action against The Devereux Foundation, a national behavioral-health, autism, and special-education provider, on behalf of individuals whose personal information may have been exposed in a network intrusion that occurred in November 2025.

What happened
According to a notice filed with the California Attorney General, Devereux identified suspicious activity within certain systems on its computer network on November 9, 2025. The organization says it moved to isolate the affected systems, assess its network, and open an investigation. That investigation determined that an unauthorized actor gained access to certain systems between November 6 and November 9, 2025, and copied files without permission.
Devereux states that it completed a comprehensive review of the affected files on June 23, 2026, and began mailing notification letters on July 23, 2026, roughly eight months after the intrusion was discovered. According to the notice, the impacted files contained recipients' names along with additional personal details described in each individual letter as the 'Data Elements Impacted.' The company reports it has no evidence of actual or attempted identity theft or fraud tied to the incident. Devereux is offering affected individuals complimentary credit monitoring through Experian.
Devereux holds information for a broad range of people, including current and former employees and their beneficiaries, clients and their loved ones, donors, payors, and business partners. Because the organization operates in behavioral health, the personal information it maintains can be especially sensitive, which is one of the questions Dapeer Law is evaluating as part of this investigation.

Common questions
I received a data breach letter from Devereux. What should I do? +
Keep your notification letter, since it contains your Experian enrollment code and serves as evidence. Enroll in the complimentary Experian credit monitoring before the October 31, 2026 deadline, and monitor your bank, credit-card, and health-insurance statements for unfamiliar activity. Because Devereux is a behavioral-health provider, it is also worth watching for any misuse of medical or insurance information. You can then speak with a data breach attorney about your options.
Am I eligible to join a class action against Devereux? +
If you received a breach notice from Devereux, you may be eligible. Devereux says it holds information for current and former employees and their beneficiaries, clients and their loved ones, donors, payors, and business partners. Eligibility can depend on your state of residence, the categories of data exposed in your individual letter, and any documented losses or time spent responding to the breach.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
The public California notice states that the impacted files contained affected individuals' names plus additional personal details it refers to as the 'Data Elements Impacted.' The notice does not list those elements publicly, so the specific information involved is set out in each recipient's individual letter. Check your letter for the details that apply to you.
Did Devereux offer free credit monitoring? +

How many people were affected by the Devereux breach? +
