What happened
According to a notice filed with the California Attorney General, Fairwinds Credit Union ("Fairwinds"), a member-owned credit union headquartered at 3087 N. Alafaya Trail in Orlando, Florida, engaged Mercadien, P.C. CPAs, an external accounting and professional services firm, to perform an independent quality-control assessment required by its regulators. As part of that engagement, Fairwinds provided Mercadien with member information needed for testing. On November 7, 2025, Mercadien discovered a cybersecurity incident in its own environment, and its investigation found that an unauthorized actor may have accessed or acquired data stored on Mercadien's systems between September 7 and November 7, 2025. Fairwinds states that its own internal systems were not affected.
Mercadien did not advise Fairwinds of the incident until August 13, 2026, more than nine months after discovery. Fairwinds reports that it reviewed the data to confirm which members were affected, completed that review on September 4, 2026, and mailed notification letters dated September 23, 2026, roughly ten and a half months after the incident was discovered. The sample notice states that the information involved may have included certain data elements but does not list them publicly, so the specific categories are identified only in each member's individual letter. The total number of affected members has not been publicly disclosed. Fairwinds states it has terminated its relationship with Mercadien and is offering complimentary Experian IdentityWorks credit monitoring, identity restoration, and identity-theft insurance, with an enrollment deadline of December 31, 2026.
Records shared with an auditor for quality-control testing at a financial institution commonly include names, addresses, account numbers, and other identifiers that can support account takeover, phishing, and financial fraud. Whether Fairwinds adequately vetted and oversaw a vendor holding member data, why Mercadien waited roughly nine months to notify the credit union, and whether the combined delay before members were told met state breach-notification requirements are among the issues being evaluated.
