What happened
On August 4, 2026, Hamilton Capital, LLC ("Hamilton Capital") began mailing letters notifying individuals of an event that may have affected some of their information. The firm reported the incident to law enforcement and filed notice with state regulators, including the Massachusetts Attorney General, where the filing is docketed as 2026-1287. According to the information reported to Massachusetts, 28 individuals were notified.
The reported categories of information involved are Social Security numbers and financial account information. Hamilton Capital is offering 24 months of complimentary Experian IdentityWorks credit monitoring, a three-bureau service, along with identity restoration support, and is directing recipients to enroll using the activation code in their letter by January 31, 2027. The notice letter does not state when the unauthorized activity occurred, when the firm discovered it, or how the information was accessed, and the letter itself notes that Massachusetts law does not permit certain information to be included in the notification.
Because Social Security numbers and financial account information are reported to be involved, affected individuals may face an elevated and long-lasting risk of identity theft, tax fraud, and unauthorized account activity. The investigation is examining whether Hamilton Capital used reasonable measures to safeguard the client information entrusted to it, whether the notice was sent within the time frame state law requires, and whether affected individuals may be entitled to monetary damages and stronger data security going forward.
What to do if you received a letter
Keep your notice letter
Do not discard it. Your letter contains the Experian activation code and the engagement number you need to enroll, and it is important evidence that your information was involved if you decide to participate in a lawsuit.
Enroll in the free 24-month credit monitoring
Enroll in the Experian IdentityWorks three-bureau monitoring offered in your letter at ExperianIDWorks.com/3bcredit using your activation code. The code stops working after January 31, 2027. Identity restoration support is available for 24 months without enrolling. Accepting these benefits does not waive your right to pursue legal action.
Place a fraud alert or credit freeze
Contact Equifax, Experian, and TransUnion to place a fraud alert or freeze on your file. Request a free weekly credit report from AnnualCreditReport.com, and use the FTC's IdentityTheft.gov recovery guide. Because Social Security numbers and financial account information are reported to be involved, also review your bank, brokerage, and retirement account statements line by line, and consider a security freeze with all three credit bureaus.

Common questions

Keep the breach notice and the activation code that came with it. Enroll in the free 24-month Experian IdentityWorks three-bureau monitoring before January 31, 2027, review your bank, brokerage, and retirement statements for activity you do not recognize, and consider a fraud alert or security freeze with all three credit bureaus. Because Social Security numbers are reported to be involved, also request an IRS Identity Protection PIN, report any suspected identity theft at IdentityTheft.gov, and speak with a data breach attorney about your legal rights.
Am I eligible to join a class action against Hamilton Capital? +
You are generally eligible to be evaluated if you received a Hamilton Capital breach notification letter mailed on or around August 4, 2026. Factors that can affect a claim include your state of residence, which categories of your information were involved, and any documented losses, out-of-pocket expenses, or time spent responding to fraud. A consumer-protection attorney can confirm your standing.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
The information reported in connection with the Massachusetts filing is Social Security numbers and financial account information. Hamilton Capital's letter to individuals describes the event in general terms and notes that Massachusetts law does not allow certain information to be included in the notification, so check your specific letter for the details that apply to you.
