Background

What happened in the Motility data breach

According to Motility's notice letter, Motility detected unusual activity within certain computer servers that support its business operations in August 2025. A supplemental notice that Motility's counsel sent to the New Hampshire Attorney General places that detection on or around August 19, 2025. Motility determined that an unauthorized actor deployed malware that encrypted a portion of its systems. The forensic evidence suggests that before encryption the unauthorized actor may have removed limited files containing personal information. According to the Indiana Attorney General, Motility sent its first notices on September 29, 2025.

On September 2, 2026, during a routine file maintenance process, Motility discovered additional files that the unauthorized actor may have accessed during the August 2025 incident. Its original investigation had not identified these files. According to the New Hampshire filing, Motility identified the individuals whose information was in these files on September 17, 2026 and notified the affected dealers on October 8, 2026. The filing also says that on October 19, 2026, Motility would begin providing written notification to affected individuals on behalf of those dealers. That supplemental notice came more than a year after the unusual activity was first detected. Motility is offering 12 months of LifeLock identity monitoring.

The notice letter filed with the New Hampshire Attorney General says the affected files vary by individual. It says they may have contained one or more of the following: full name, postal address, e-mail address, telephone number, date of birth, social security number, driver's license number, and credit or debit card number, expiration date, and security code. The Texas filing lists Social Security Number Information, Driver's License number, Financial Information and Date of Birth. Motility reported 767,562 affected individuals to the Texas Attorney General and 766,000 affected individuals to the Indiana Attorney General. The issues being evaluated include whether Motility's security practices met legal standards and whether the time it took to find the additional files caused further harm.
