How Much Can You Receive

Payout amounts depend on how many units you purchased and whether you have receipts:

  • Florida (No proof): $3 per unit, up to 5 units ($15 max)

  • New York (No proof): $4 per unit, up to 5 units ($20 max)

  • Florida (With proof): $3 per unit, up to 20 units ($60 max)

  • New York (With proof): $4 per unit, up to 20 units ($80 max)

If you bought Gerber Good Start Gentle (GSG) infant formula in Florida or New York between October 10, 2011, and April 23, 2016, you may be entitled to up to $80no proof of purchase required for basic claims.

This class action lawsuit accused Gerber Products Company of false advertising, claiming the formula could reduce the risk of allergies and atopic dermatitis, despite a lack of scientific support. Plaintiffs also alleged that Gerber misrepresented the formula as FDA-endorsed for allergy prevention. Gerber denies all wrongdoing but has agreed to a settlement to resolve the litigation.

Who Can File a Claim?

Anyone who purchased Gerber Good Start Gentle infant formula for personal use (not for resale or through WIC/Food Stamps) in Florida or New York during the class period — October 10, 2011, to April 23, 2016 — may qualify for compensation.

You’ll need to provide:

  • The infant’s name and birthdate

  • Your relationship to the infant

  • The state where the purchase was made

If you no longer live in Florida or New York, you can still qualify by showing you lived there during the class period. One claim per household is allowed.
