How Much Can You Receive?

💼 Payment Based on Workweeks
Each eligible class member will receive a payment based on the total number of weeks they worked under the day-rate plan during the covered period.
📊 Point System Explained:
Each eligible workweek = 1 point
The total fund is divided by the total number of points to determine a per-week dollar value
Your payment = Per-week value × Your total eligible workweeks
📩 The specific per-week value and estimated payment amount are detailed in the notice sent to class members.
About
Red Oak Sanitation LLC agreed to a $1.41 million class action settlement to resolve claims that it violated the Fair Labor Standards Act (FLSA) by failing to properly pay overtime to certain employees.
The lawsuit alleged that Red Oak Sanitation paid nonexempt drivers and helpers under a day-rate pay plan without compensating them for overtime hours worked beyond 40 hours per week. This practice allegedly violated federal wage laws designed to protect hourly workers.
Claims in the lawsuit included:
Failure to pay overtime
Use of an unlawful day-rate system
Violations of the FLSA
Red Oak denied any wrongdoing but agreed to settle to avoid the costs and risks of ongoing litigation. The settlement provides compensation based on the number of workweeks class members were employed under the day-rate plan between Oct. 2, 2021, and Jan. 31, 2025.
