What happened
On March 2, 2026, BAYADA Home Health Care, Inc. ("BAYADA") became aware of a cybersecurity event affecting its IT environment. BAYADA states that it immediately initiated its incident response protocols and engaged third-party forensic specialists, who determined that an unauthorized actor had gained access to certain BAYADA systems and copied data between February 18 and March 2, 2026.
After securing its network, BAYADA engaged data review specialists and completed a detailed review of the affected data on July 1, 2026, then began mailing notification letters on or around July 17, 2026, more than four months after the incident was discovered. The letters state that the information involved includes each recipient's name plus additional personal elements that are itemized individually and are not listed in the publicly filed sample notice. BAYADA is offering single-bureau credit monitoring through Cyberscout, a TransUnion company, with a 90-day enrollment window.
Because BAYADA is a home health care provider, the files at issue may include health-related information subject to HIPAA in addition to standard identifiers. Whether BAYADA's pre-breach security practices met legal standards, the full categories of data involved, and whether the notification delay caused additional harm are among the issues being evaluated.

Common questions
I received a data breach letter from BAYADA Home Health Care. What should I do? +
Keep the letter, enroll in the free Cyberscout (TransUnion) credit monitoring within the 90-day window printed in your notice, review your account statements and explanations of benefits for unfamiliar activity, place a fraud alert or credit freeze on your credit file, and contact a data breach attorney for a free consultation. Am I eligible to join a class action against BAYADA Home Health Care? +
If you received a July 2026 breach notice from BAYADA Home Health Care, you are likely eligible for a free case evaluation. Eligibility depends on your state of residence, the categories of your data that were exposed, and any losses you have suffered. Dapeer Law will review your notice at no cost.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
BAYADA's public sample notice confirms that names were involved, along with additional personal elements that are itemized separately in each recipient's individual letter and are not listed in the public filing. Because BAYADA is a home health care provider, the exposed data may include health-related information in addition to standard identifiers. Check your individual letter for the specific categories of your data that were involved.
Did BAYADA Home Health Care offer free credit monitoring? +
Yes. BAYADA is providing complimentary single-bureau credit monitoring, credit report, and credit score services through Cyberscout, a TransUnion company, along with fraud assistance. You must enroll within 90 days from the date of your letter. The publicly filed sample notice does not state the length of the monitoring term. Enrollment is separate from, and does not waive, your right to pursue a claim.
How many people were affected by the BAYADA Home Health Care breach? +
The total number of affected individuals has not been publicly disclosed as of the July 17, 2026 notice. This page will be updated as additional information becomes available.
Is there a deadline to take legal action? +
Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.
