What happened
Eckert Seamans Cherin & Mellott, LLC ("Eckert Seamans"), a Pittsburgh-based national law firm, detected suspicious activity within its computer network and says it contained the activity and engaged outside cybersecurity professionals to conduct a forensic investigation. On August 17, 2026, that investigation confirmed that an unauthorized party had accessed or acquired files containing personal information. The date the suspicious activity was first detected has not been publicly disclosed.
After completing its review of the affected files, Eckert Seamans notified law enforcement and began contacting affected individuals. The firm filed notice with the Massachusetts Attorney General and reported mailing letters on September 3, 2026, roughly 17 days after the unauthorized access was confirmed. According to that filing, the involved information includes full names, Social Security numbers, and driver's license numbers, and 94 individuals are listed as affected. The number of individuals notified nationwide has not been publicly disclosed. The firm states that it has no evidence of misuse and is offering affected individuals complimentary credit and CyberScan monitoring through IDX, a $1,000,000 insurance reimbursement policy, and fully managed identity theft recovery services.
Law firms hold some of the most sensitive information their clients have, and the categories reported here, a Social Security number paired with a name and a driver's license number, are the combination most useful for opening credit in someone else's name and for filing fraudulent tax returns. That risk does not expire with a monitoring enrollment period. Whether the firm's data security practices met the standards required of a custodian of client information, how long the unauthorized party had access before the activity was detected, and whether the data involved needed to be retained at all are among the issues being evaluated.
What to do if you received a letter
Keep your notice letter
Do not discard it. Your letter contains the IDX enrollment code and is important evidence if you decide to participate in a lawsuit.
Enroll in the free IDX credit and CyberScan monitoring
Enroll in the complimentary IDX monitoring offered in your letter before the deadline printed on it. The letter also explains how to activate the $1,000,000 insurance reimbursement policy and the identity theft recovery services. Accepting these benefits does not waive your right to pursue legal action.
Place a fraud alert or credit freeze
Contact Equifax, Experian, and TransUnion to place a fraud alert or freeze on your file. Request a free weekly credit report from AnnualCreditReport.com, and use the FTC's IdentityTheft.gov recovery guide. Because a Social Security number and a driver's license number were reported as involved, also watch for tax filings made in your name and for any notice of a driver's license or state ID issued in a state where you do not live.

Common questions
I received a data breach letter from Eckert Seamans. What should I do? +
Keep the letter, enroll in the free IDX credit and CyberScan monitoring before the deadline printed in your notice, and place a fraud alert or a security freeze with all three credit bureaus. Order your free credit reports and review them for accounts you did not open, and review your bank and credit card statements for charges you do not recognize. Because a Social Security number was reported as involved, also watch for tax filings and government benefit claims made in your name. If you see signs of identity theft, report it to the Federal Trade Commission and your local police, and contact the provider listed in your letter. Enrolling in monitoring does not waive your right to sue.
Am I eligible to join a class action against Eckert Seamans? +
If you received a September 2026 breach notice from Eckert Seamans about this incident, you are likely eligible for a free case evaluation. Eligibility depends on your state of residence, the categories of your information that were involved, and any financial harm or time you have spent dealing with fraud. Note that a law firm may hold information about people who were not its direct clients, such as opposing parties or beneficiaries in a legal matter, so a notice recipient does not need to have been a client. Dapeer Law will review your notice at no cost.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
According to the notice filed with the Massachusetts Attorney General, the involved files contained full names, Social Security numbers, and driver's license numbers. The firm has not published a breakdown showing which categories applied to which individuals, so your own letter is the most reliable statement of what was involved for you.
Did Eckert Seamans offer free credit monitoring? +
Yes. Eckert Seamans is offering affected individuals complimentary credit monitoring and CyberScan monitoring through IDX, along with a $1,000,000 insurance reimbursement policy and fully managed identity theft recovery services. The term of the monitoring is not stated in the public filing. Your letter contains the enrollment code, the enrollment deadline, and instructions for activating each benefit. Enrollment does not waive your right to pursue a claim.
How many people were affected by the Eckert Seamans breach? +
The notice filed in Massachusetts lists 94 individuals as affected. Eckert Seamans has not publicly disclosed how many individuals were notified in total across all states, and law firm breaches are frequently reported to several state regulators separately. This page will be updated as additional information becomes available.
Is there a deadline to take legal action? +
Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.
How do I get a copy of the official breach notice? +
