What happened
Aesto, LLC, a company that provides healthcare data migration and archiving services to healthcare providers, experienced a network security incident on or about December 18, 2025 that affected a limited portion of its Amazon Web Services infrastructure. According to the notice filed with the California Attorney General, between on or about December 2, 2025 and December 18, 2025 an unauthorized actor may have accessed and/or acquired files that included protected health information belonging to Everside Health patients. Aesto has stated that it commenced an investigation and worked with external cybersecurity professionals experienced in handling incidents of this type.
Aesto confirmed on May 26, 2026 that protected health information may have been accessed, and it informed Everside Health on June 26, 2026. Notice letters were mailed and the incident was reported to the California Attorney General on or about July 31, 2026, roughly seven months after the unauthorized activity ended. The public version of the letter identifies full name together with additional protected health information maintained by Everside Health, but the specific data elements are not listed in that version, so each recipient's individual letter is the most reliable source for what was involved.
Because the information at issue is health information held for a primary care provider, exposure of that type of data can raise the risk of medical identity theft in addition to ordinary financial fraud. Affected individuals are being offered a complimentary 12 or 24 month membership in Privacy Solutions ID, administered by Epiq, and Aesto has said it is not aware of any misuse of the information as of the date of its notice. Everside Health merged with Marathon Health in 2024, and patients with questions about this incident are directed to the contact information printed in their mailed letter or to Aesto's response line at 833-918-8060.
What to do if you received a letter
Keep your notice letter
Do not discard it. Your letter contains the Privacy Solutions ID activation code and identifies the specific categories of protected health information involved for you, both of which are important if you decide to participate in a lawsuit.
Enroll in the free Privacy Solutions ID membership
Activate the complimentary 12 or 24 month Privacy Solutions ID membership described in your letter at www.privacysolutionsid.com, using the activation code printed in the letter, before the enrollment deadline it states. Accepting this benefit does not waive your right to pursue legal action.
Place a fraud alert or credit freeze
Contact Equifax, Experian, and TransUnion to place a fraud alert or freeze on your file. Request a free weekly credit report from AnnualCreditReport.com, and use the FTC's IdentityTheft.gov recovery guide. Because this incident involved health information, also review your explanation of benefits statements and medical bills for services you do not recognize.

Common questions
I received a data breach letter from Everside Health. What should I do? +
Keep your letter, activate the free Privacy Solutions ID membership at www.privacysolutionsid.com using the code it provides, and consider placing a fraud alert or security freeze on your credit files with Equifax, Experian, and TransUnion. Because this incident involved protected health information, also review your explanation of benefits statements and medical bills for services you do not recognize. You can then contact a data breach attorney for a no-cost review of your legal rights.
Am I eligible to join a class action against Everside Health? +
If you received the July 2026 notice regarding the Aesto incident affecting Everside Health patient information, you are a confirmed notice recipient and may qualify to participate in a class action or an individual case. Eligibility can depend on your state of residence, the categories of protected health information listed in your specific letter, and any losses you can document.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
The notice states that a limited amount of protected health information may have been accessed and/or acquired, and identifies full name along with additional protected health information maintained by Everside Health. The public version of the letter filed with the California Attorney General does not list the specific data elements, so your individual letter is the most reliable source for what was involved in your case.
Did Everside Health offer free credit monitoring? +
The notice offers a complimentary 12 or 24 month membership in Privacy Solutions ID, an identity protection service administered by Epiq, rather than a single named credit monitoring product. The term offered and the enrollment deadline are stated in each individual letter. Enrolling does not waive your right to pursue legal action.
How many people were affected by the Everside Health breach? +
The number of individuals affected was not disclosed in the California Attorney General filing, and the notice letter does not state a figure. This page will be updated if a count is published in a regulator filing or in the HHS Office for Civil Rights breach portal.
Is there a deadline to take legal action? +
Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.
How do I get a copy of the official breach notice? +
The notice was filed with the California Attorney General's data breach portal and is available there as a PDF. You can download it from that portal, or Dapeer Law can help you request a copy during a free consultation.
