Dapeer Law, P.A. is investigating a potential class action against Health Management Systems, Inc., a healthcare technology company affiliated with Gainwell Technologies, on behalf of individuals whose personal information may have been exposed after an employee posted a photograph of their workstation, which displayed sensitive data, to a personal social media account in April 2026.

What happened
According to a notice filed with the Massachusetts Attorney General, on April 21, 2026 an employee of Health Management Systems, Inc. uploaded a photograph of their workstation to a personal Facebook account. The image inadvertently displayed personal information belonging to at least one individual. The company states the post was visible only to the employee's friends-only audience until the company demanded its removal.
Health Management Systems mailed notification letters on June 16, 2026, roughly two months after the incident was discovered. According to the notice, the exposed information included name, address, Social Security number, claim number, and a reference indicating that the billing provider was a behavioral health center. The company is offering affected individuals 24 months of complimentary identity protection through IDX, including credit and CyberScan monitoring, up to $1,000,000 in identity theft insurance, and managed identity recovery assistance. The Massachusetts filing reported one affected individual, and the total number of people affected in other states is not clear from the public filing.
Because the disclosed information included a Social Security number and a reference associating the individual with behavioral health services, the incident carries both identity theft risk and the exposure of sensitive health-related information. Our investigation focuses on whether stronger data-handling safeguards and employee policies could have prevented this disclosure and whether affected individuals received timely, adequate notice.
