Background

What happened

On February 3, 2026, Hawaii Employers Mutual Insurance Company, Inc. (HEMIC), a workers' compensation insurance carrier headquartered in Honolulu, Hawaii, detected suspicious activity on its computer network. The company engaged outside cybersecurity specialists, and the resulting forensic investigation determined that an unauthorized actor had accessed a limited segment of HEMIC's network on February 2, 2026 and copied files during that session. HEMIC then conducted a file-by-file review to identify the specific individuals and information involved.

HEMIC filed a formal data breach notice with the Maine Attorney General on May 13, 2026 and began mailing notification letters to affected individuals on the same date, more than three months after the suspicious activity was first discovered. The public filing states that the impacted files contained recipient names along with additional personal information that is being disclosed individually in each person's letter, without itemizing the full categories of data (such as Social Security numbers, dates of birth, financial account information, or workers' compensation claim details) in the public notice. HEMIC is offering complimentary Experian IdentityWorks credit-monitoring and identity-restoration services to those affected.

Because workers' compensation insurers routinely collect highly sensitive employee and policyholder information, including Social Security numbers, dates of birth, employment and wage data, and medical records tied to injury claims, the specific categories of data exposed in this incident, whether HEMIC's pre-breach security controls met applicable legal and industry standards, and whether the multi-month notification delay caused additional harm to affected individuals are among the issues being evaluated.

FAQ

Common questions

I received a data breach letter from HEMIC. What should I do? +

Keep the letter, enroll in the complimentary Experian IdentityWorks credit-monitoring and identity-restoration services before the deadline printed on your notice, place a free fraud alert or security freeze on your credit file with one of the three major bureaus, review your bank, credit card, and any workers' compensation claim statements for unfamiliar activity, and contact a data breach attorney for a free consultation. Accepting credit monitoring does not waive your right to sue.

Am I eligible to join a class action against HEMIC? +

If you received a May 2026 data breach notice from HEMIC, you are likely eligible for a free case evaluation. Eligibility depends on your state of residence, the categories of your data that were exposed, and any losses you have suffered. Dapeer Law will review your notice at no cost.

How much money could I receive from a class action lawsuit? +

Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.

What personal information was exposed in the breach? +

HEMIC's public filing with the Maine Attorney General states that the impacted files contained recipient names along with additional personal information being disclosed individually in each affected person's letter, without itemizing the full categories in the public notice. Because HEMIC is a workers' compensation carrier, the exposed data may include some combination of names, addresses, dates of birth, Social Security numbers, employment and wage information, or medical and injury-claim details. Your individual notice letter should specify the categories of your data that were involved.

Did HEMIC offer free credit monitoring? +

Yes. HEMIC is offering complimentary Experian IdentityWorks credit-monitoring and identity-restoration services. Use the unique enrollment code printed in your notice and enroll before the deadline stated in the letter. The public filing does not state the duration of the free coverage. Enrollment is separate from, and does not waive, your right to pursue a claim.

How many people were affected by the HEMIC breach? +

The total number of affected individuals was not disclosed in the May 13, 2026 filing with the Maine Attorney General. This page will be updated as additional information becomes available.

Is there a deadline to take legal action? +

Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.
