What happened
On or about September 25, 2025, MCBS, LLC ("MCBS"), a nationwide healthcare management services company, determined that an unauthorized individual had gained access to its computer network. An investigation conducted with outside cybersecurity professionals confirmed that between September 22 and September 26, 2025, certain files containing personal and health information were subject to unauthorized acquisition.
MCBS completed its review of the affected files on May 28, 2026 and filed notice with the California Attorney General on June 26, 2026, mailing letters to affected individuals on or shortly after that date, more than nine months after the intrusion was discovered. The notice does not publicly itemize the specific categories of data involved, which vary by individual. MCBS is offering complimentary identity-protection services, though the duration was not specified in the notice.
Because the exposed files contained health information, the incident may implicate obligations under HIPAA and state health-privacy laws. Whether MCBS's pre-breach security practices met legal standards, and whether the lengthy notification delay caused additional harm, are among the issues being evaluated.

Common questions
I received a data breach letter from MCBS. What should I do? +
Keep the letter, enroll in the complimentary identity-protection services offered in your notice before any deadline, review your medical records and Explanation of Benefits statements for unfamiliar services, place a fraud alert on your credit file, and contact a data breach attorney for a free consultation. Accepting identity protection does not waive your right to sue.
Am I eligible to join a class action against MCBS? +
If you received a breach notice from MCBS, you are likely eligible for a free case evaluation. Eligibility depends on your state of residence, the categories of your data that were exposed, and any losses you have suffered. Dapeer Law will review your notice at no cost.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
MCBS's public notice states that files containing personal and health information were accessed but does not itemize specific categories, which vary by individual. Because MCBS is a healthcare management services company, the exposed data may include some combination of names, contact details, dates of birth, Social Security numbers, health information, and insurance details. Your individual notice letter should specify the categories of your data that were involved.
Did MCBS offer free credit monitoring? +
Yes. MCBS is providing complimentary identity-protection services as a precaution, though the notice did not specify the duration or the provider. Enroll before any deadline printed in your letter. Enrollment is separate from, and does not waive, your right to pursue a claim.
How many people were affected by the MCBS breach? +
The total number of affected individuals has not been publicly disclosed in the California Attorney General filing as of June 26, 2026. This page will be updated as additional information becomes available.
Is there a deadline to take legal action? +
Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.
How do I get a copy of the official breach notice? +
The notice filed with the California Attorney General is available through the California AG's public data breach portal (linked in Sources below). If you received a letter but no longer have it, Dapeer Law can assist you in obtaining a copy during your free consultation.
