What happened
Nebraska Orthopaedic Center, P.C. ("Nebraska Orthopaedic Center") notified patients that personal information stored by one of its vendors, Aesto, was accessed without authorization. Aesto hosts a portion of the practice's data on Amazon Web Services infrastructure. According to the notice filed with the Massachusetts Attorney General, an unauthorized actor copied certain protected health information from Aesto's environment between December 2 and December 18, 2025. Aesto engaged outside cybersecurity specialists to investigate and contain the intrusion.
Aesto states that on May 26, 2026 it confirmed the information involved in the incident. Nebraska Orthopaedic Center began mailing written notices to affected individuals on August 18, 2026 and reported the event to the Massachusetts Attorney General the following day. The notice identifies full name, medical record number, date of birth, and Social Security number as the data elements involved, and reports 208 individuals affected in the Massachusetts filing. The practice is offering 24 months of complimentary single-bureau credit monitoring, credit report, and credit score services through Cyberscout, a TransUnion company. Roughly eight months passed between the end of the intrusion and notification of affected individuals, a delay that Dapeer Law is evaluating.
Because the information was held on behalf of a healthcare provider and included Social Security numbers alongside medical record numbers, patient data involved in this incident may be subject to protections under federal and state health-privacy laws and carries a heightened risk of identity theft and medical-claim fraud.
