Background

What happened

According to a notice filed with the Massachusetts Attorney General, Sweetwater Development & Management Company was informed by Ultimus Fund Solutions, the third-party vendor that provides its fund administration services, that Ultimus had experienced a data security incident. The company states that the unauthorized activity occurred in the vendor's environment rather than on Sweetwater's own network. After Ultimus confirmed the scope of the incident, Sweetwater says it worked with cybersecurity specialists to verify the details and determine its notification obligations.

Sweetwater Development & Management began mailing notification letters on August 14, 2026 and filed notice with the Massachusetts Attorney General as filing No. 2026-1359, which lists one affected Massachusetts resident. The Massachusetts filing reports that the information involved included Social Security numbers and driver's license numbers. The company is offering 24 months of complimentary credit monitoring and identity protection through CyberScout, a TransUnion company, with enrollment required within 90 days of the date of the letter. Neither the notice nor the regulator filing states when the incident at Ultimus occurred or when it was discovered, so the length of any notification delay is not yet publicly known and is part of what this investigation is evaluating.

A Social Security number cannot be changed the way a payment card number can, and pairing it with a driver's license number gives an identity thief most of what is needed to open credit in someone else's name, file a fraudulent tax return, or obtain identification. Vendor incidents also raise a distinct question, which is whether the company that collected the information exercised reasonable care in selecting and overseeing the outside firm it handed that information to. Dapeer Law is evaluating both the security practices at issue and the adequacy of the notice provided.

What to do if you received a letter

1

Keep your notice letter

Do not discard it. Your letter contains the enrollment code for credit monitoring and is important evidence if you decide to participate in a lawsuit.

2

Enroll in the free 24-month credit monitoring

Enroll in the CyberScout (TransUnion) credit monitoring and identity protection offered in your letter. The notice requires enrollment within 90 days of the date of the letter, so act promptly. Accepting this benefit does not waive your right to pursue legal action.

3

Place a fraud alert or credit freeze

Contact Equifax, Experian, and TransUnion to place a fraud alert or freeze on your file. Request a free weekly credit report from AnnualCreditReport.com, and use the FTC's IdentityTheft.gov recovery guide. Because Social Security and driver's license numbers were reported to be involved, also watch for credit applications you did not submit, unfamiliar accounts on your credit report, IRS or state tax notices about wages you did not earn, and any correspondence from a motor vehicle agency in a state where you have not applied for a license.

FAQ

Common questions

I received a data breach letter from Sweetwater Development & Management. What should I do? +

Keep your breach letter, enroll in the free CyberScout (TransUnion) credit monitoring within the 90-day window described in the letter, and consider placing a fraud alert or a security freeze with Equifax, Experian, and TransUnion. Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount.
