Actelion / Janssen Tracleer & Bosentan Antitrust Class Action Settlement — Third-Party Payors Can Claim a Share of $65M

A $65 million settlement resolves third-party payor antitrust claims that Actelion Pharmaceuticals and Janssen Research & Development delayed generic bosentan from reaching the U.S. market. Health plans, insurers, union benefit funds, and other TPPs that paid for Tracleer or bosentan in 29 states, DC, or Puerto Rico between December 29, 2015 and September 6, 2024 can file a pro rata claim by August 3, 2026. Individual consumers are not part of this class.

Discover agreed to pay between $540 million and $1.225 billion plus interest to resolve allegations it misclassified certain consumer credit cards as commercial, overcharging merchants on interchange fees from 2007 to 2023.
