What happened
Birtcher Anderson & Davis Associates, Inc. ("Birtcher Anderson & Davis"), a San Juan Capistrano, California based commercial real-estate firm, identified unauthorized access to its network that began on or around March 30, 2026. The company states that it secured its network, launched an internal review, and engaged independent cybersecurity professionals to conduct a forensic investigation.
On June 8, 2026, the forensic investigation confirmed that certain files containing personal information had been accessed. Birtcher Anderson & Davis began mailing written notices on or around July 13, 2026 and filed its disclosure with the Massachusetts Attorney General the same month, more than three months after the unauthorized access began. The notice states that the affected files contained Social Security numbers. The company is offering impacted individuals a complimentary membership in Identity Defense Complete credit and identity monitoring, with activation details provided in the notification letter. The Massachusetts filing reports that one individual, a Massachusetts resident, was notified, though the full scope of the incident across other states is among the issues being evaluated.
Because Social Security numbers were involved, affected individuals face a heightened and long-lasting risk of identity theft and financial fraud. Whether the company's pre-breach data security practices met legal standards, and whether the interval between the March 30, 2026 start of the unauthorized access and the July 2026 notifications caused additional harm, are among the questions under review.

Keep your notification letter, enroll in the complimentary Identity Defense Complete credit and identity monitoring before the deadline printed in your notice, and consider placing a fraud alert or security freeze on your credit files with the three major bureaus. Because Social Security numbers were involved, monitor your credit reports and financial accounts closely and contact a data breach attorney for a free consultation. Am I eligible to join a class action against Birtcher Anderson & Davis? +
If you received a July 2026 breach notice from Birtcher Anderson & Davis, you are likely eligible for a free case evaluation. Eligibility depends on your state of residence, the categories of your data that were exposed, and any losses you have suffered. Dapeer Law will review your notice at no cost.
How much money could I receive from a class action lawsuit? +
Data breach class action recoveries vary significantly. Settlements typically range from a few hundred dollars for basic out-of-pocket losses to several thousand dollars for documented identity theft, with class size, damages, and negotiation all affecting the final amount. No payout is guaranteed, and this investigation has not yet resulted in a settlement.
What personal information was exposed in the breach? +
Birtcher Anderson & Davis has confirmed that the affected files contained Social Security numbers. Your individual notice letter should specify the categories of your data that were involved.
Did Birtcher Anderson & Davis offer free credit monitoring? +
Yes. The company is offering a complimentary membership in Identity Defense Complete credit and identity monitoring. The Massachusetts Attorney General filing indicates that one individual, a Massachusetts resident, was notified. The total number of individuals affected across all states has not been separately disclosed. This page will be updated as additional information becomes available.
Is there a deadline to take legal action? +
Yes. Statutes of limitations for data breach claims vary by state and legal theory, typically ranging from one to six years. Waiting can permanently bar your claim. Contact us as soon as possible for a free evaluation.
How do I get a copy of the official breach notice? +
