CSX Transportation, Inc. (CSXT) agreed to a $1.5 million settlement to resolve claims arising from the November 22, 2023 train derailment and chemical spill near Livingston in Rockcastle County, Kentucky, which prompted an evacuation. Anyone who lived in or owned residential property within a three-mile radius of the derailment site on November 22, 2023 can claim up to $4,000 per household, less any money CSXT already paid them after the derailment, and payments may increase pro rata to as much as $6,000 if funds remain. Do you qualify?

You are a Class Member if ALL of the following apply:

  • You resided within a three-mile radius of the CSXT train derailment site in Rockcastle County, Kentucky (near Livingston) on November 22, 2023.
  • Or you owned residential real property within that three-mile radius on November 22, 2023, even if you did not live there.
  • You can provide proof of residency or ownership showing your name and the property address, such as a utility bill, driver's license, lease, property tax assessment, or voter registration. The settlement website has an address lookup tool to check whether a property falls inside the Class Area.
  • One claim is paid per household. If CSXT already paid you money after the derailment (for example, evacuation reimbursement), that amount is deducted from your settlement payment.
  • Excluded: CSXT and its current employees; Class Counsel; the judge presiding over the case; and anyone who files a timely, valid request to be excluded by October 5, 2026.

What happened

On November 22, 2023, a freight train operated by CSX Transportation derailed near the town of Livingston in Rockcastle County, Kentucky, spilling chemicals and prompting an evacuation of the surrounding area over the Thanksgiving holiday. A week later, residents Lauren Webb, Debbie Francisco, and Lawrence Thayer filed this class action in the U.S. District Court for the Eastern District of Kentucky, seeking to recover for alleged personal harm and property damage suffered by people who lived in or owned homes near the derailment site. The parties reached a settlement in January 2026, and the Court granted preliminary approval on June 30, 2026.

CSXT denies the allegations, denies any wrongdoing, fault, liability, or damage in connection with the derailment, and denies that it acted improperly in any way. The Court has not decided who is right. Both sides agreed to settle to avoid the cost and risk of a trial, and CSXT has taken into account the expense and time required to defend the case through trial.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you lived in or owned residential real property within a three-mile radius of the CSXT derailment site in Rockcastle County, Kentucky on November 22, 2023. The settlement website has a Check Eligibility tool where you can enter an address to see whether it falls inside the Class Area. If you received a notice in the mail, your address was identified as inside the area.

  • 2. Gather your proof of residency or ownership

    Every claim must include documentation showing your name and the property address as of November 22, 2023, such as a utility bill, driver's license, lease, real property tax assessment, voter registration, or similar official record. Each household or property owner is eligible for up to $4,000, less any money CSXT already paid you after the derailment. If money remains after all valid claims are paid, payments increase pro rata up to a maximum of $6,000 per household.

  • 3. File online or by mail

    Submit the Claim Form online at LivingstonDerailmentSettlement.com/form/claim by October 19, 2026, or download a paper Claim Form from the Important Documents page and mail it (postmarked by October 19, 2026) to: CSXT Livingston Derailment Settlement, c/o Claims Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958. The Notice, Settlement Agreement, and Preliminary Approval Order are posted at LivingstonDerailmentSettlement.com.

  • 4. Receive your payment

    Payments are issued after the Court grants final approval at the December 9, 2026 Final Approval Hearing and any appeals are resolved, which can take a year or more. You can choose PayPal, Venmo, Zelle, a prepaid e-Mastercard, or a paper check, and you can update your address or payment method on the settlement website until February 23, 2027. No other follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for December 9, 2026 at 10:00 a.m. Eastern at the U.S. District Court for the Eastern District of Kentucky, 310 S. Main Street, London, KY 40741 (courtroom to be announced). The Court may move the hearing, so check LivingstonDerailmentSettlement.com for updates before traveling.

Where the money is going

This is a $1.5 million common fund. Court-approved attorneys' fees and litigation expenses, Class Representative awards, and notice and administration costs come out of the fund before household payments are made. If money remains after all valid claims are paid at $4,000, payments increase pro rata up to $6,000 per household; any remainder after that goes to a cy pres recipient approved by the Court.

All amounts listed above are pending and subject to final court approval at the December 9, 2026 Final Approval Hearing. Class Counsel's motion for fees and expenses had not been posted to the settlement website as of this writing; the Court may award less than the amounts requested. Payments to each household are reduced by any money CSXT previously paid that household after the derailment.

Common questions

How much money will I receive?

Each eligible household or residential property owner can receive up to $4,000, minus any money CSXT already paid you after the derailment (such as evacuation or inconvenience payments). If money remains in the $1.5 million fund after attorneys' fees, expenses, Class Representative awards, administration costs, and all valid $4,000 claims are paid, every valid claim is increased pro rata up to a maximum of $6,000 per household. Only one claim is paid per household.

Do I need to submit proof of purchase?

Yes. Your Claim Form must include proof that you lived at or owned residential property at an address inside the three-mile Class Area on November 22, 2023. Acceptable proof includes a utility bill, driver's license, lease, real property tax assessment invoice, voter registration, or similar official document. The document must show your name and the property address. If you no longer have a record from that period, your utility provider, county PVA office, or landlord can usually supply one.

What if I didn’t receive a notice?

You can still file a claim if you did not receive a postcard or email notice. Notice was mailed to addresses the parties identified inside the three-mile radius, but renters, former residents who have since moved, and out-of-area property owners may have been missed. Use the Check Eligibility tool at LivingstonDerailmentSettlement.com to confirm your address is inside the Class Area, then file online or by mail with your proof by October 19, 2026.

Does staying in the class affect my right to sue later?

Yes. Unless you submit a written request for exclusion postmarked by October 5, 2026, you stay in the Settlement Class and release CSXT from all claims that were or could have been brought in this lawsuit arising from the November 22, 2023 derailment, including claims for personal injury, medical monitoring, property damage or diminution in value, emotional distress, inconvenience, and wrongful death or survivorship. If you have significant individual injuries or property losses that exceed the settlement payment, review the release carefully and consider consulting a lawyer before the opt-out deadline. If you exclude yourself, you receive no payment but keep your right to sue on your own.

When will payments be sent out?

The Court will hold the Final Approval Hearing on December 9, 2026 at 10:00 a.m. Eastern in London, Kentucky. Payments are issued only after final approval is granted and any appeals are resolved, which can take a year or more. When payments go out, you will receive them in the format you selected (PayPal, Venmo, Zelle, prepaid e-Mastercard, or check). You can update your address or payment method on the settlement website until February 23, 2027.
