National Association of Realtors $44M Class Action Settlement

Higher Tech Realty LLC (d/b/a Mark Spain Real Estate), eXp World Holdings Inc., Weichert of North America Inc., and Atlanta Communities Real Estate Brokerage LLC have agreed to pay $44.05 million to settle a class action lawsuit.
The lawsuit alleges these companies participated in anticompetitive practices that led to home sellers overpaying in commissions, violating federal antitrust law (specifically the Sherman Act). The companies deny any wrongdoing but settled to avoid further litigation.
Who Can File a Claim?
You may be eligible to file a claim if:
You sold a home in the U.S. between October 31, 2019, and July 22, 2025
Your home was listed on a Multiple Listing Service (MLS)
You paid a commission to a real estate agent or brokerage in connection with the sale
Note: The MLS does not need to be affiliated with the National Association of Realtors (NAR).
If you sold multiple homes, you must file a separate claim for each sale.
What You’ll Need to File
Claimants must provide documentation that proves the home sale, commission paid, and MLS listing.
Acceptable proof includes:
Closing or settlement statements
HUD statements
Commission payment records
MLS listings with transaction info
Settlement letters or escrow documents
How Much Can You Receive?
If your claim is approved, you’ll receive a pro rata share of the $44.05 million fund. Your payout depends on:
How many valid claims are submitted
The commission amount you paid
Deductions for legal fees and administrative costs
There is no set dollar amount per claim — the more people who file, the smaller each share may be.
