SunTrust Overdraft Fee Class Action Settlement

SunTrust Bank (now Truist Bank) agreed to pay up to $240 million to settle a class action alleging its overdraft fees on certain ATM and debit card transactions violated Georgia's usury laws. Georgia citizens who paid an unrefunded overdraft fee on a $500-or-less ATM or debit transaction between July 12, 2006 and April 15, 2014 can file a claim online or by mail by September 14, 2026 for a pro rata payment calculated from SunTrust's own account records.

Do you qualify?

You are a Class Member if ALL of the following apply:

  • You had one or more SunTrust Bank deposit accounts that were not closed before June 1, 2010.
  • Between July 12, 2006 and April 15, 2014, you had at least one overdraft of $500 or less resulting from an ATM or debit card transaction, paid an overdraft fee on it, and did not receive a refund of that fee.
  • You were a Georgia citizen on July 12, 2010 and continuously remained a Georgia citizen through October 6, 2017.
  • Excluded: SunTrust (Truist Bank) and its officers, directors, agents, and affiliates; the judge presiding over the case; and the 158 individuals who previously opted out of the class.

What happened

A SunTrust deposit account holder filed a class action in the State Court of Fulton County, Georgia, alleging that SunTrust's overdraft fees on certain ATM and debit card transactions constituted interest under Georgia's usury laws, which limit the amount of interest a lender can charge. The lawsuit, Bickerstaff v. SunTrust Bank, also alleged conversion and money had and received. The Georgia Court of Appeals later held that class members who closed their SunTrust accounts before June 1, 2010 must arbitrate their claims, and that class members could not pursue claims for overdraft fees charged after April 15, 2014.

SunTrust denies that its overdraft fees constituted interest and denies any wrongdoing or liability. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The Court granted final approval of the Settlement at the May 26, 2026 Fairness Hearing.

How to file a claim

  • 1. Confirm you are eligible

    You must have held a SunTrust deposit account that was not closed before June 1, 2010, with at least one overdraft of $500 or less from an ATM or debit card transaction between July 12, 2006 and April 15, 2014 for which you paid a fee and were not refunded. You must also have been a Georgia citizen from July 12, 2010 through October 6, 2017.

  • 2. No math required — SunTrust's records set your amount

    You do not need to calculate anything. The Settlement Administrator uses SunTrust's own records to total each account's unrefunded overdraft fees plus 7% simple interest through December 31, 2025, then pays each account its pro rata share of the Net Settling Class Member Funds. Every valid claim is guaranteed at least $5, and joint accounts split the payment if more than one Settling Class Member on the account files.

  • 3. File online or by mail

    Submit the Claim Form you were mailed or emailed online at suntrustoverdraftclassaction.com by September 14, 2026, or mail the paper Claim Form (postmarked by September 14, 2026) to: Bickerstaff v. SunTrust Bank, Settlement Administrator, PO Box 2873, Portland, OR 97208-2873. If you believe you qualify but never received a Claim Form, call 1-877-239-8765 or email info@suntrustoverdraftclassaction.com right away.

  • 4. Receive your payment

    The Court granted final approval of the Settlement at the May 26, 2026 Fairness Hearing. Settling Class Members who submit a valid, timely Claim Form will receive a check or Zelle payment from the Settlement Administrator. No further action is required once your claim is submitted.

The Court held the Fairness and Final Approval Hearing on May 26, 2026 at 1:30 p.m. in Courtroom 2A, Justice Center Tower, State Court of Fulton County, 185 Shirley Clarke Franklin Blvd. SW, Atlanta, GA 30303, and granted final approval of the Settlement. The opt-out and objection deadlines of April 20, 2026 have passed; the only remaining step is filing a Claim Form. Where the money is going

This is a claims-made settlement, not a fixed common fund. SunTrust will pay up to $240 million total, but only for accounts where a Settling Class Member submits a valid, timely Claim Form; if no one files for an account, that account's share stays with SunTrust. Attorneys' fees, costs, the Class Representative service award, and notice and administration costs are deducted before the remaining Net Settling Class Member Funds are divided pro rata.

These fee, cost, and service award figures reflect the Court's Final Approval Order. Individual payments are calculated pro rata from what remains after notice and administration costs are also deducted, based on each account's unrefunded overdraft fees plus 7% simple interest through December 31, 2025, with a $5 minimum payment per account. Accounts with no Claim Form filed receive nothing, and those funds remain with SunTrust.

Common questions

How much money will I receive?

There is no fixed per-claimant amount. SunTrust's own records are used to calculate an "Account Total" — your unrefunded overdraft fees plus 7% simple interest through December 31, 2025 — and each account receives its pro rata share of the Net Settling Class Member Funds after fees, costs, and the service award are deducted. Every valid claim is guaranteed at least $5. Joint accounts split the payment if more than one Settling Class Member on the account files a claim.

Do I need to submit proof of purchase?

No documentation is required. SunTrust's own records already identify Settling Class Members and the overdraft fees on their accounts, and the Settlement Administrator uses those records to calculate each Account Total.

What if I didn’t receive a notice?

If you believe you qualify but did not receive a postcard or email notice, you must contact the Settlement Administrator immediately at 1-877-239-8765 or info@suntrustoverdraftclassaction.com to update your contact information. Without a notice on file, you will not automatically receive a Claim Form and will not be able to get a payment.

Does staying in the class affect my right to sue later?

Yes. Unless you excluded yourself by the April 20, 2026 deadline (which has passed), you are a Settling Class Member and you release your claims against SunTrust arising out of the overdraft fees at issue in this lawsuit, whether or not you file a claim or receive a payment. The opt-out and objection windows are now closed; filing a Claim Form by September 14, 2026 is the only remaining step to receive money.

When will payments be sent out?

The Court granted final approval of the Settlement at the May 26, 2026 Fairness Hearing. Claim Forms were mailed and emailed to Settlement Class Members beginning July 14, 2026, and must be submitted online or postmarked by September 14, 2026. The Settlement Administrator will send a check or Zelle payment to each Settling Class Member with a valid, timely claim.
