- Excluded: Anyone who was not sent a Notice Letter by TRC about the Data Breach.

What happened
TRC Staffing Services, Inc. is a staffing company. The lawsuit concerns a data breach that took place in the spring of 2024, reported to have run from late March through April 12, 2024. TRC sent notice letters to people whose Private Information may have been compromised, reported to be about 158,000 people, and the information involved is reported to include names and Social Security numbers. Several lawsuits were filed in 2024 and consolidated in the Northern District of Georgia.
TRC denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The $1,700,000 Settlement Fund pays court-approved attorneys' fees, service awards, and administration costs, and the rest goes to class members who file valid claims.
How to file a claim

1. Confirm you are eligible
You qualify if you live in the United States and TRC sent you a Notice Letter saying your Private Information may have been compromised in the 2024 Data Breach. Find the Class Member ID on your notice, since the online Claim Form asks for it to log in. If you cannot find it, call the Settlement Administrator at (833) 930-0160.

2. Choose your cash option
You pick one of two options. Option 1 reimburses up to $5,000 in documented Monetary Losses and/or up to four hours of Lost Time at $20 per hour. Option 2 is an Alternative Pro Rata Cash Payment of up to $200 that requires no documentation. The Option 2 amount depends on how many valid claims are filed and may be less than $200.

3. File online or by mail
Submit the Claim Form online at the official claim portal by December 22, 2026, or download a paper Claim Form and mail it, postmarked by December 22, 2026, to TRC Staffing Services Data Breach Settlement, c/o Kroll Settlement Administration, PO Box 5324, New York, NY 10150-5324. 4. Receive your payment
Cash payments are issued after the Court grants final approval at the January 6, 2027 Final Approval Hearing and any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for January 6, 2027 at 11:00 a.m. ET before the United States District Court for the Northern District of Georgia. The deadline to opt out or object is December 7, 2026. The Court will also consider Class Counsel's request for attorneys' fees of up to one-third of the fund ($566,666.67) plus litigation costs and service awards for the Class Representatives. The Court may move the hearing, so check TRCDataSettlement.com for updates before traveling.
Where the money is going
TRC will pay $1,700,000 into a Settlement Fund. Court-approved attorneys' fees and expenses, service awards, and notice and administration costs are paid first. Valid documented loss and lost time claims are then paid, and the Alternative Pro Rata Cash Payments are calculated from what remains.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The Alternative Pro Rata Cash Payment depends on the number of valid claims and the money remaining in the fund, and may be less than $200.

How much money will I receive?

Do I need to submit proof of purchase?
It depends on the option. The Alternative Pro Rata Cash Payment requires no documentation. Documented Monetary Losses require proof such as receipts or statements. Every claim requires the Class Member ID from your notice.
What if I didn’t receive a notice?
The class is limited to people TRC sent a Notice Letter, and the online Claim Form requires the Class Member ID from that notice. If you believe you were sent a notice but lost it or moved, contact Kroll Settlement Administration at (833) 930-0160 or PO Box 5324, New York, NY 10150-5324 before the December 22, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to sue or be part of any other lawsuit against TRC over the legal claims resolved by this settlement, whether or not you file a claim. To keep those rights, you must opt out by December 7, 2026.
When will payments be sent out?
Payments are distributed after the Court grants final approval at the January 6, 2027 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
