About

Whole Foods Market California Inc. and Mrs. Gooch’s Natural Food Markets Inc. have agreed to settle a class action lawsuit for up to $650,000. The lawsuit alleges that these companies sold 12-ounce canisters of 365 Organic Hot Cocoa Rich Chocolate Flavor Mix and 365 Everyday Value Organic Hot Cocoa Rich Chocolate Flavor Mix with excessive empty space inside the containers, commonly known as “nonfunctional empty space.” This packaging design may have misled California consumers into believing they were getting more product than the canister actually contained.

The claims asserted violations of California consumer protection laws, including the Consumer Legal Remedies Act, Unfair Competition Law, and False Advertising Law. Whole Foods and Mrs. Gooch’s deny any wrongdoing but settled to avoid further litigation costs and uncertainty.

How to File a Claim

You can file a claim by:

  • Submitting online through the official settlement website, or

How Much Can You Receive?

Eligible class members who submit a valid and timely claim will receive a pro rata share of the $100,000 allocated for claimant payments from the $650,000 total settlement fund.

  • The estimated payout per claimant is between $2.90 and $4.10, but this amount will vary depending on the total number of valid claims filed.

  • If some funds remain undistributed after the initial payouts, the settlement administrator may conduct a second distribution to eligible claimants who cashed their payments. To qualify for this, the second payment must be at least $1.

  • Any funds left unclaimed after the second distribution will be donated to the California Association of Food Banks, subject to court approval.
