What happened
The American Medical Collection Agency (AMCA), a billing collections vendor used by medical laboratories, reported a cybersecurity incident affecting its computer systems from about August 1, 2018 through March 30, 2019. Plaintiffs allege that personally identifiable information and protected health information of lab patients was affected. This settlement resolves the claims in the multidistrict litigation against Sonic Healthcare U.S.A., Aurora Diagnostics LLC, Clinical Pathology Laboratories, Inc., and Austin Pathology Associates, pending in the United States District Court for the District of New Jersey before Judge Jamel K. Semper.
The Defendants deny that they did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the costs, risks, and uncertainty of continued litigation.

Where the money is going
The Defendants agreed to pay $6,438,578.20 into a settlement fund that covers out-of-pocket loss payments, medical monitoring, alternative cash payments, notice and administration costs, taxes, service awards, and attorneys' fees and expenses. Alternative cash payments are distributed evenly from what remains after other benefits and costs.
All amounts above are maximums and subject to Court approval at the January 7, 2027 Final Fairness Hearing. The Court may award less. The alternative cash payment is estimated at $50 and may increase or decrease depending on the number of approved claims.
Common questions
How much money will I receive?
You can claim up to $5,000 for documented, unreimbursed losses fairly traceable to the incident, including up to 10 hours of documented lost time at $25 per hour. Or you can choose an alternative cash payment estimated at $50, which is adjusted pro rata. You may also enroll in up to two years of medical monitoring. Amounts are not guaranteed.
Do I need to submit proof of purchase?
Out-of-pocket loss and lost time claims require receipts or other documentation and an attestation; self-prepared documents such as handwritten receipts are not enough on their own. The alternative cash payment requires no documentation.
What if I didn’t receive a notice?
The class is limited to people who were sent a notice by or on behalf of Clinical Pathology Laboratories or Austin Pathology Associates. If you believe you were but did not get a settlement notice, get more information from the settlement website directly at AMCADataBreachSettlement.com or call (833) 453-3715.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by December 3, 2026, you will be bound by the settlement and cannot sue the Defendants over claims arising from or related to the incident, whether or not you file a claim. The full release is in the Settlement Agreement on the settlement website.
When will payments be sent out?
The Court will hold the Final Fairness Hearing on January 7, 2027. Payments are made only after final approval and any appeals are resolved, which can take a year or more. Check the settlement website for updates.
