ASP Aesthetics LP has agreed to a $1,319,450 settlement to resolve allegations that it continued to send marketing text messages to customers after those customers asked it to stop, in violation of the Telephone Consumer Protection Act (TCPA). U.S. residents who received a text message from ASP Aesthetics after asking them to stop can submit a Claim Form by June 11, 2026. Eligible claimants can receive up to $55 for each qualifying text message received, covering up to ten texts, for a potential maximum of $550 per person.

Do you qualify?
You are a Class Member if ALL of the following apply:
- You are a U.S. resident who, during the Class Period, sent a request to ASP Aesthetics LP asking it to stop sending you text messages.
- After making that stop request, you received at least one additional text message from ASP Aesthetics LP (or someone acting on its behalf) on your cellular telephone regarding its goods, products, or services.
- Excluded: ASP Aesthetics LP and its officers, directors, agents, employees, affiliates, and Related Parties; immediate family members of any such persons; and the judge presiding over the case.
- Excluded: Any Settlement Class Member who has already opted out of the Settlement.

What happened
Plaintiff Tysen Hansen filed this class action lawsuit in the Circuit Court of the Eighteenth Judicial Circuit in DuPage County, Illinois, alleging that ASP Aesthetics LP violated the Telephone Consumer Protection Act (TCPA) by sending marketing text messages to cellular telephone numbers after the recipients had already asked the company to stop. The TCPA is a federal law that restricts the use of marketing-related text messages without prior express consent and gives consumers the right to revoke consent and demand that texts stop. The lawsuit sought statutory damages on behalf of Hansen and all similarly situated U.S. consumers who received unwanted texts from ASP Aesthetics after requesting that the messages cease.
ASP Aesthetics LP denies each and every allegation of wrongdoing, liability, and damages, and disputes that the claims would be appropriate for class treatment if the litigation proceeded to trial. The Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation. The $1,319,450 Settlement Fund is intended to compensate Settlement Class Members who file valid claims.

1. Confirm you are eligible
You qualify if you are a U.S. resident who, during the Class Period, asked ASP Aesthetics LP to stop sending you marketing text messages and then received at least one additional text from the company after making that request. The Settlement Administrator uses records from ASP Aesthetics to identify class members, so if you received a notice, you are likely eligible.

2. Tally up your claim
You can receive up to $55 for each qualifying text message you received after your opt-out request, covering up to ten texts based on Settlement Class Data. The maximum recovery is $550 per claimant. Payments are subject to reduction if total valid claims exceed the amount available in the Settlement Fund after attorneys' fees, administration costs, and the service award are deducted.

3. File online or by mail
Submit the Claim Form online at ASPTCPASettlement.com/claimform.aspx by June 11, 2026, or mail a paper Claim Form (postmarked by June 11, 2026) to: Hansen v. ASP Aesthetics LP, c/o Settlement Administrator, P.O. Box 16, West Point, PA 19486.

4. Receive your payment
Payments will be issued by check within 60 days after the Court grants final approval and the judgment becomes final after any appeals are resolved. If anyone appeals the settlement, payment may be delayed by the appeal process, which can take a year or more. No follow-up is required once your Claim Form is submitted.

The Final Approval Hearing is scheduled for May 27, 2026 at 9:30 a.m. CDT before the Honorable Louis B. Aranda in Courtroom 2016 of the Eighteenth Judicial Circuit Court of DuPage County, 505 N. County Farm Road, Wheaton, IL 60187, or by remote means as ordered by the Court. The Court may move the hearing, so check ASPTCPASettlement.com for updates before traveling. Note: the opt-out and objection deadlines of May 1, 2026 have passed.
Where the money is going
This is a non-reversionary common fund. Attorneys' fees and expenses (up to 33%), the service award to the Class Representative, and notice and administration costs all come out of the $1,319,450 Settlement Fund before per-claimant payments are calculated.
All amounts are pending and subject to final court approval at the May 27, 2026 Fairness Hearing. The Court may award less than the amounts requested. Per-claimant payments of up to $55 per qualifying text (up to 10 texts) are subject to reduction on a pro rata basis if total valid claims exceed the available net fund.

Do I need to submit proof of purchase?
You do not need to submit phone records or documentation to file. The Claim Form requires you to complete it fully and accurately and make the required affirmations and representations. The Settlement Administrator will verify your eligibility against Settlement Class Data from ASP Aesthetics' records.
What if I didn’t receive a notice?
Yes. Even if you did not receive a mailed notice, you may still file a claim if you qualify. Contact the Settlement Administrator at (888) 542-0068 or by email at questions@ASPTCPASettlement.com to request a Claim Form, or download one at ASPTCPASettlement.com.
Does staying in the class affect my right to sue later?
Yes. Unless you opted out of the Settlement by the May 1, 2026 deadline (which has passed), you will be bound by the Court's judgment and release your TCPA-related claims against ASP Aesthetics arising from the text messages at issue in this lawsuit. When will payments be sent out?
