Crimson Wine Group, Ltd. (CWG) agreed to a $637,500 settlement over a June 2024 targeted cyberattack that accessed files containing class members' Private Information, including names, Social Security numbers, and financial account information. Settlement Class Members nationwide can claim up to $5,000 for documented losses, or an estimated $100 no-proof cash payment, plus two years of credit monitoring.

You are a Class Member if ALL of the following apply:
- You reside in the United States and your Private Information was accessed and/or acquired by an unauthorized party as a result of the data breach CWG reported in June 2024.
- You may have already received a notice directly from CWG confirming you are a Settlement Class Member.
- Excluded: Directors and officers of Crimson Wine Group, Ltd.; the judge assigned to the case, that judge's immediate family, and Court staff; and anyone who properly submits a timely Request for Exclusion.

What happened
Named plaintiff Joanne Kaplan sued Crimson Wine Group, Ltd. over a targeted cyberattack on CWG's computer systems that occurred in or about June 2024. The lawsuit alleges that files containing Private Information, including names, Social Security numbers, and financial account information, were accessed by an unauthorized party during the incident.
CWG denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation.
How to file a claim

1. Confirm you are eligible
You must be a U.S. resident whose Private Information was accessed or acquired in the June 2024 CWG data incident. You may have already received a notice directly from CWG confirming you're a Settlement Class Member.

2. Choose your cash payment
Pick one of two options, not both: reimbursement for documented out-of-pocket losses (bank fees, replacement ID costs, credit monitoring fees, and identity theft losses) up to $5,000, or a one-time pro rata cash payment currently estimated at $100 with no documentation required. Everyone can also claim 2 years of credit monitoring regardless of which cash option is chosen.

3. File online or by mail
Submit the Claim Form online at crimsonwinesettlement.com/form/claim by September 1, 2026, or mail a paper Claim Form (postmarked by September 1, 2026) to: CWG Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799.

4. Receive your payment
Payments are issued after the Court grants final approval at the October 13, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for October 13, 2026 at 8:30 a.m. Pacific Time in Department B of the Napa County Superior Court, 1111 3rd St., Napa, CA 94559, and via Zoom. The Court may move the hearing, so check CrimsonWineSettlement.com for updates before traveling.
Where the money is going
Attorneys' fees, costs, a service award for the Plaintiff, and settlement administration costs come out of the $637,500 fund first. Class Counsel's fee request (up to 35%) is based on the settlement's full value, including non-monetary relief, not just this cash fund. The remaining balance funds credit monitoring services and cash payments for class members.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than requested. Cash Payment B (the no-proof option) is estimated at $100 and will be adjusted up or down on a pro rata basis depending on the number of valid claims submitted.
Common questions
How much money will I receive?
You may claim one of two cash payments, not both, plus two years of credit monitoring regardless of which cash option you pick. Cash Payment A reimburses documented out-of-pocket losses (bank or card fees, ID replacement costs, credit monitoring fees, and identity theft losses) up to $5,000, with third-party documentation like receipts required. Cash Payment B is a one-time pro rata cash payment currently estimated at $100, with no documentation required; the actual amount may increase or decrease depending on how many valid claims are submitted.
Do I need to submit proof of purchase?
Only Cash Payment A requires proof, third-party documentation such as receipts showing your out-of-pocket losses. Self-prepared documents can support other documentation but are not sufficient on their own. If you don't have documentation, Cash Payment B lets you claim an estimated $100 pro rata cash payment with no proof required, and all Settlement Class Members can also claim 2 years of credit monitoring regardless of proof.
What if I didn’t receive a notice?
You may still be a Settlement Class Member even if you haven't received a notice directly from CWG. The Settlement Class is defined as all U.S. residents whose Private Information was accessed or acquired in the June 2024 data incident CWG reported. Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself (opt out) by mailing a written Request for Exclusion postmarked by August 3, 2026, you will be bound by the Settlement and will give up the right to sue, continue to sue, or be part of any other lawsuit against CWG about the legal claims this Settlement resolves. When will payments be sent out?
The Court will hold the Final Approval Hearing on October 13, 2026 at 8:30 a.m. Pacific Time. Settlement Class Member Benefits (credit monitoring and cash payments) will be issued after the Court grants final approval and any appeals are resolved; the parties don't know how long an appeal process would take if one is filed. No action is required after you submit a valid Claim Form.
