FMC Services, LLC has agreed to a $2.15 million settlement over a data incident that compromised the personal and health information of its patients. Settlement Class Members whose personally identifiable information or protected health information was exposed in the July 26, 2022 data incident can claim cash payments and identity monitoring.

- Your personally identifiable information or personal health information was compromised in the FMC Services data incident that occurred on or about July 26, 2022, including anyone who received notice of the incident.
- Excluded: Directors, officers, and agents of FMC Services, LLC, and its subsidiaries and affiliated companies; governmental entities; and the judge assigned to the case, that judge's immediate family, and court staff.

What happened
Plaintiffs Deneli Sharber, Shanna Byers, Lyle Schafer, and Jennifer Hart filed this class action against FMC Services, LLC after the company experienced a data incident on or about July 26, 2022, in which an unauthorized third party allegedly accessed and acquired private information stored on FMC's computer systems. The exposed information allegedly included some combination of names, mailing addresses, dates of birth, Social Security numbers, and medical information belonging to FMC's patients. Plaintiffs brought claims for negligence, negligence per se, breach of fiduciary duty, breach of implied contract, and unjust enrichment.
FMC Services denies that any information was actually acquired and denies any fault, liability, or wrongdoing in connection with the allegations. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation.
How to file a claim

1. Confirm you are eligible
You must have received notice, or otherwise had your personally identifiable information or personal health information compromised, in the FMC Services data incident that occurred on or about July 26, 2022.

2. Choose your cash payment
Elect Cash Payment A for documented losses, up to $5,000 with supporting documentation such as receipts, correspondence, or phone records, or elect Cash Payment B for an alternate cash payment estimated at $75 with no documentation required. Adult Class Members can also claim two years of CyEx medical data monitoring, and minors can claim two years of CyEx minor monitoring, in addition to either cash option.

3. File online or by mail
Submit the Claim Form online at fmcdatasettlement.pnclassaction.com by August 31, 2026, or mail a paper Claim Form (postmarked by August 31, 2026) to: FMC Data Settlement Administrator, P.O. Box 1789, Baton Rouge, LA 70821.

4. Receive your payment
Payments are issued after the Court grants final approval at the September 15, 2026 Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

The Fairness Hearing is scheduled for September 15, 2026 at 9:00 a.m. CT in the 320th District Court, Potter County, Texas, 350 SE 6th Ave., Suite 4A, Amarillo, Texas 79101. The Court may move the hearing, so check FMCDataSettlement.com for updates before traveling.
Where the money is going
This is a non-reversionary common fund. Attorneys' fees, service awards, and notice and administration costs come out of the $2.15 million before payments are calculated for class members.
All amounts listed above are pending and subject to final court approval at the Fairness Hearing. The Court may award less than the amounts requested. If valid claims exceed what remains of the fund, payments will be reduced on a pro rata basis.
Common questions
How much money will I receive?
You may elect Cash Payment A for documented losses, up to $5,000 upon presentment of reasonable documentation (such as receipts, correspondence, or phone records) supporting expenses related to the data incident, or Cash Payment B, an alternate cash payment estimated at $75 that requires no documentation. Adult Class Members can also claim two years of CyEx medical data monitoring, and minors can claim two years of CyEx minor monitoring, in addition to either cash option. All payments are subject to pro rata adjustment if valid claims exceed the funds available.
Do I need to submit proof of purchase?
Cash Payment B, the $75 alternate cash payment, does not require documentation. Cash Payment A, the up-to-$5,000 documented-losses payment, requires reasonable supporting documentation contemporaneously generated by a third party or by you, such as telephone records, correspondence, or receipts. Personal certifications or affidavits alone do not qualify as documentation, though they may support other submitted records.
What if I didn’t receive a notice?
The Settlement Class includes all persons whose personally identifiable information or personal health information was compromised in the data incident, including anyone who was sent notice. If you believe your information was involved but are unsure whether you received notice, contact the Settlement Administrator at 1-844-609-0700 or info@FMCDataSettlement.com, or visit FMCDataSettlement.com.
Does staying in the class affect my right to sue later?
Yes. Unless you opt out by mailing a written exclusion request postmarked by August 17, 2026, you will be bound by the Settlement and you will release the legal claims at issue in this lawsuit against FMC Services and the other Released Parties. That means you cannot sue FMC Services separately over the data incident. The full release language is in Section XIII of the Settlement Agreement, available at FMCDataSettlement.com.
When will payments be sent out?
The Court will hold the Final Approval Hearing on September 15, 2026 at 9:00 a.m. CT in the 320th District Court, Potter County, Texas. Payments will only be issued after the Court grants final approval and any appeals are resolved, a process that can take a year or more. No action is required after a valid Claim Form is submitted; check FMCDataSettlement.com for updates.
