Rancho Mesquite Casino, Inc. (which does business as Eureka Casino Hotel) agreed to a $1 million settlement over allegations that a November 2022 data security incident exposed Social Security numbers, financial account numbers, passport numbers, and driver's license or state ID numbers copied from Eureka's network. U.S. residents whose Private Information was compromised in the November 9-13, 2022 incident can claim up to $5,000 in documented out-of-pocket losses, plus a $100 California Statutory Cash Payment for California residents, and a pro rata share of any remaining funds.

  • Your Private Information was compromised in the Eureka Data Security Incident that occurred between November 9, 2022 and November 13, 2022 (most class members were sent direct notice of the incident).
  • California residents (or anyone who resided in California at any point between November 9, 2022 and the claim filing deadline) qualify for an additional $100 California Statutory Cash Payment with a sworn attestation of California residency.
  • Excluded: Eureka's directors and officers; the judge presiding over the case and that judge's immediate family and Court staff; and anyone found guilty (or who pleads nolo contendere) of initiating, causing, aiding, or abetting the Data Security Incident.

What happened

The lawsuit alleges that between November 9 and November 13, 2022, Rancho Mesquite Casino, Inc. (doing business as Eureka Casino Hotel) experienced a data security incident in which certain personally identifiable information, including full names, Social Security numbers, financial account numbers, passport numbers, and driver's license or state-issued identification numbers, was copied from Eureka's computer network. Several individual cases were consolidated into In re: Eureka Casino Breach Litigation in the U.S. District Court for the District of Nevada.

Eureka denies the allegations and denies any wrongdoing or liability, and the Court has not decided in favor of either side. The parties agreed to settle to avoid the cost, disruption, and time of continued litigation. The settlement establishes a $1,000,000 non-reversionary common fund to pay documented out-of-pocket losses, a $100 California Statutory Cash Payment for California residents, and a residual pro rata cash payment to all class members who file a Valid Claim.

How to file a claim

    Confirm you are eligible

    You must be a U.S. resident whose Private Information was compromised in the November 9-13, 2022 Eureka Data Security Incident. Most class members were sent a direct notice of the incident. California residents (current or at any point since November 9, 2022) also qualify for an additional $100 cash payment.

    Tally up your claim

    You can claim up to $5,000 for actual, documented, unreimbursed out-of-pocket losses caused by the Data Security Incident (incurred between November 9, 2022 and the Claim Deadline), so long as you made reasonable efforts to mitigate or seek reimbursement first. California residents can also claim a $100 California Statutory Cash Payment with a sworn attestation of California residency. Any money left in the fund after Valid Claims are paid is distributed pro rata to claimants. All payments are subject to pro rata reduction if Valid Claims exceed available funds.

    File online or by mail

    Submit the Claim Form online at echdatasettlement.com/submit-claim by May 11, 2026, or mail a paper Claim Form (postmarked by May 11, 2026) to: Eureka Data Security Incident Litigation Settlement Administrator, Attn: Claim Forms, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103.     Receive your payment

    Payments are issued after the Court grants final approval at the June 10, 2026 Final Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your Claim Form and supporting documentation are submitted.

The Final Fairness Hearing is scheduled for June 10, 2026 at 10:00 a.m. PT in Courtroom 6B of the Lloyd D. George Federal Courthouse, 333 Las Vegas Boulevard South, Las Vegas, NV 89101. The Court may move the hearing without further notice, so check ECHDataSettlement.com or PACER before traveling.

Where the money is going

This is a non-reversionary $1,000,000 common fund. Attorneys' fees and costs, service awards, and notice and administration costs come out of the $1 million before payments are calculated for class members.

How much money will I receive?

Do I need to submit proof of purchase?

Yes, documentation is required for the out-of-pocket reimbursement claim. The Notice states that failure to provide supporting documentation will result in denial of the claim, and self-prepared documents (such as handwritten receipts) are by themselves insufficient. The $100 California Statutory Cash Payment can be claimed with a sworn attestation of California residency. What if I didn’t receive a notice?

You can still file a claim if you did not receive a direct notice, so long as your Private Information was compromised in the November 9-13, 2022 incident. Notice in this case was sent to people Eureka identified as affected, with publication and online notice as backup. If you believe you are a Settlement Class Member, visit ECHDataSettlement.com or call the Settlement Administrator at 1-888-688-4260.

Does staying in the class affect my right to sue later?

Yes. Unless you opt out by mailing a written, individually signed exclusion request postmarked by April 9, 2026, you will be bound by the Settlement and you will release the legal claims at issue against Eureka and its Related Entities and Released Persons (including parents, subsidiaries, affiliates, directors, officers, employees, agents, attorneys, and insurers). That means you cannot sue Eureka separately about the same Data Security Incident. The full release language is in the Settlement Agreement, available at ECHDataSettlement.com.

When will payments be sent out?

The Court will hold the Final Fairness Hearing on June 10, 2026 at 10:00 a.m. PT in Courtroom 6B of the Lloyd D. George Federal Courthouse in Las Vegas. Payments will only be issued after the Court grants final approval and any appeals are resolved. The appeal process can take a year or more. No action is required after a Valid Claim Form is submitted, just check ECHDataSettlement.com for status updates.
