Fairchild Medical Center Pixel Tracking Class Action Settlement

Siskiyou Hospital, Inc., which operates Fairchild Medical Center in Yreka, California, agreed to settle a class action alleging that it used the Meta Pixel and related tracking technologies on its website in a way that disclosed patients' private information to third parties without authorization, in violation of California privacy laws. The roughly 1,000 California residents in the class can claim a $25 cash payment with no documentation and enroll in one year of CyEx Privacy Shield Pro online privacy protection.   • You are a California citizen whose Private Information was disclosed by Fairchild Medical Center to third parties through the Meta Pixel and related tracking technologies on its website without authorization.
  • You are on Fairchild Medical Center's list of approximately 1,000 affected individuals. The Settlement Administrator mailed each class member a postcard notice with a CyEx enrollment code, so if you received the postcard you are in the class.
  • No documentation or explanation is required for the $25 cash payment or the privacy protection enrollment.
  • Excluded: The judge in the case and the judge's family and staff; Fairchild Medical Center and its officers, directors, and related companies; attorneys for the parties; the legal representatives, successors, or assigns of any excluded person; and anyone who validly excludes themselves by September 28, 2026.

What happened

Plaintiff Lori Delgado filed this class action in the Superior Court of California, County of Siskiyou, alleging that Fairchild Medical Center embedded the Meta Pixel and related third-party tracking technologies on its website, including pages patients use to search for providers, book appointments, and access health information. According to the complaint, those tools transmitted patients' identifying information and details about their website activity to Meta and other third parties without patients' knowledge or consent, in violation of California privacy laws. Fairchild Medical Center is a rural hospital serving Siskiyou County in far northern California.

Fairchild Medical Center denies that it did anything wrong and denies any liability. The Court has not decided whether the Plaintiff or the Defendant is right. Both sides agreed to settle to avoid the cost and risk of a trial and to get benefits to class members promptly. Because this is a claims-made settlement, Fairchild Medical Center pays each approved $25 claim and the cost of the privacy protection service directly, and separately pays Class Counsel's fees and costs and the Class Representative's service award, so those amounts do not reduce class member payments.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you are a California citizen whose Private Information was shared with third parties through the tracking pixels on Fairchild Medical Center's website. The class is a closed list of about 1,000 people identified by the hospital, and each received a postcard notice with a CyEx Privacy Shield Pro enrollment code. If you were a Fairchild Medical Center patient who used its website and did not get a postcard, call the Settlement Administrator to check whether you are on the list.

  • 2. Claim your benefits

    There are two benefits and you can take both. First, a one-time $25 cash payment that requires no proof or explanation; just complete the Claim Form. Second, one year of CyEx Privacy Shield Pro, which includes dark web scanning, compromised password scanning, a VPN, a password manager, and other privacy tools, with access to a fraud resolution agent if anything suspicious turns up. Enrollment codes were printed on the postcard notice; if you no longer have yours, request a replacement through the Enrollment Instructions Request page on the settlement website or by calling the Administrator.

  • 3. File online or by mail

    Submit the Claim Form online at FairchildDataSettlement.com/form/claim by November 2, 2026, or download the printable Claim Form from the Important Documents page and mail it (postmarked by November 2, 2026) to: Fairchild Medical Center Pixel Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799. The Long Form Notice and Settlement Agreement are posted at FairchildDataSettlement.com.

  • 4. Receive your payment

    Payments are issued after the Court grants final approval at the October 15, 2026 Final Approval Hearing and any appeals are resolved. Note that the hearing falls before the claim deadline, so checks will not go out until after November 2, 2026 at the earliest and the process can take longer if an appeal is filed. Cash is sent in the payment format you select on the Claim Form. The CyEx Privacy Shield Pro enrollment can be activated now using the code on your postcard.

Where the money is going

This is a claims-made settlement with no common fund. Fairchild Medical Center pays each approved class member $25 and covers the cost of one year of CyEx Privacy Shield Pro for everyone who enrolls. Class Counsel's fees and costs and the Class Representative's service award are paid by Fairchild Medical Center separately, so they do not reduce what class members receive.

All amounts listed above are pending and subject to final court approval at the October 15, 2026 Final Approval Hearing. The Court may award less than the fees and service award requested. Because this is a claims-made settlement, the $25 payment is fixed and is not reduced by the number of claims filed.

Common questions

How much money will I receive?

Every class member who files a valid Claim Form receives a one-time $25 cash payment. Because this is a claims-made settlement rather than a common fund, the amount does not go up or down based on how many people file. In addition, every class member can enroll in one year of CyEx Privacy Shield Pro (dark web scanning, compromised password scanning, VPN, password manager, and fraud resolution support) using the enrollment code on their postcard notice, whether or not they claim the cash.

Do I need to submit proof of purchase?

No. The Claim Form asks only for your contact information and payment preference. You do not need to provide any proof or explanation to receive the $25 payment, and enrolling in CyEx Privacy Shield Pro requires only the code from your postcard notice (or a replacement code from the Administrator).

What if I didn’t receive a notice?

The class is a closed list of approximately 1,000 California residents identified from Fairchild Medical Center's records, and each was mailed a postcard notice with an enrollment code. If you were a Fairchild Medical Center patient who used its website and believe your information was shared but did not receive a postcard, contact the Settlement Administrator at 1-833-421-7353 or info@FairchildDataSettlement.com to ask whether you are on the class list. You can also request a replacement enrollment code through the settlement website.

Does staying in the class affect my right to sue later?

Yes. Unless you mail or email a signed Request for Exclusion by September 28, 2026 to Fairchild Medical Center Pixel Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799, you remain in the class and release Fairchild Medical Center from the claims relating to its use of tracking pixels described in Section 3 of the Settlement Agreement. If you opt out, you receive no payment or privacy protection but keep your right to sue on your own. You may only exclude yourself, not anyone else.

When will payments be sent out?

The Court will hold the Final Approval Hearing on October 15, 2026 at 9:30 a.m. Pacific in Yreka, California. Because the claim deadline (November 2, 2026) falls after the hearing, payments cannot go out until the claims period closes, final approval is granted, and any appeals are resolved. The Settlement Administrator has said it cannot predict whether appeals will be filed. Cash is sent in the payment method you select on the Claim Form; the privacy protection can be activated right away with your enrollment code.
