A federal class action lawsuit alleges that Newell Brands and NUK USA misled consumers by labeling certain pacifiers as "orthodontic" when, plaintiffs allege, no such oral health benefit exists. Do you qualify?

You are a Class Member if ALL of the following apply:

  • Purchased any NUK-branded Orthodontic Pacifier (including NUK Space, NUK Latex, NUK Sports, NUK Confetti, NUK Fashion, NUK Sensitive, or NUK Juicy Orthodontic Pacifiers) in California, Florida, Illinois, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, New York, or Washington.
  • Purchase was made on or after October 16, 2019 and on or before May 14, 2026.
  • Excluded: Newell Brands Inc., NUK USA LLC, and their officers, directors, agents, and affiliates; past and present employees of Defendants; and the judge and court staff presiding over this case.

What happened

Plaintiffs Shelly Benson and Lisa Caparelli filed a class action lawsuit alleging that Newell Brands Inc. and its subsidiary NUK USA LLC violated consumer protection laws in ten states by labeling their pacifiers as "orthodontic." Plaintiffs allege the "orthodontic" designation leads parents to believe these pacifiers promote healthier oral development than other pacifiers, and that this claim is not supported. Plaintiffs contend the misleading label caused consumers to pay a price premium they would not otherwise have paid, and seek recovery for those alleged economic losses only.

Defendants deny all allegations of wrongdoing and contend that the "orthodontic" label accurately describes their product and is not misleading in any way. The Court has certified the case as a class action but has not yet decided who is right. No settlement has been reached and no money is currently available to class members.

How to file a claim

  • 1. Confirm you are a class member

    You are included if you purchased any NUK-branded Orthodontic Pacifier in CA, FL, IL, MA, MI, MN, MO, NJ, NY, or WA on or after October 16, 2019 and on or before May 14, 2026.

  • 2. Decide whether to stay in or opt out

    If you do nothing, you remain in the class and will be bound by any judgment or future settlement. You may be eligible for money if Plaintiffs prevail. If you opt out, you preserve the right to sue Defendants separately but will not share in any class recovery. There is no claim form or payout available at this time.

  • 3. Submit an opt-out request by August 24, 2026 (if opting out)

    To exclude yourself, mail a signed letter with your name, address, and a statement that you wish to be excluded from the Ten-State Class in Benson et al. v. Newell Brands Inc., et al., Case No. 1:19-cv-06836, postmarked by August 24, 2026, to: NUK Notice Administrator, P.O. Box 3507, Portland, OR 97208-3507.

  • 4. Monitor the case for a future settlement or trial outcome

How much money will I receive?

No payout is available at this time. If Plaintiffs win at trial or a settlement is later reached, class members will be notified about how to submit a claim and receive money. The amount, if any, will depend on the outcome of trial or negotiation.

Do I need to submit proof of purchase?

No claim form currently exists, so no documentation is required right now. If a claims process opens in the future, the settlement administrator will provide instructions on what documentation, if any, is needed.

What if I didn’t receive a notice?

If you did not receive a notice but purchased a qualifying NUK Orthodontic Pacifier in one of the ten states within the class period (October 16, 2019 through May 14, 2026), you are still a class member. Does staying in the class affect my right to sue later?

If you remain in the class and the case resolves (whether by trial verdict or future settlement), you will be bound by the Court's judgment and cannot sue Defendants separately over the same claims. To preserve your right to sue independently, you must opt out by August 24, 2026.

When will payments be sent out?

No payments are expected in the near term. The case must go to trial, or a settlement must be reached and receive final court approval, before any money is distributed to class members. This process typically takes a year or more after trial or settlement.
