What happened
Plaintiffs Joanne Vannier and James Ciuffo filed this class action against Parks Heritage Federal Credit Union over a targeted cyberattack on Parks Heritage's computer systems that occurred in July 2024. Certain files containing private information were accessed, which may have included names, Social Security numbers, financial information, credit card numbers, and debit card numbers.
Parks Heritage denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, disruptions, and uncertainties of continuing the litigation. The settlement does not establish a common fund; instead, Parks Heritage separately pays approved claims (subject to per-benefit caps), two years of credit monitoring for all enrolled Class Members, Court-approved attorneys' fees and costs, and Service Awards.

Where the money is going
This Settlement does not establish a common fund. Instead, Parks Heritage separately pays approved claims (subject to per-benefit caps), credit monitoring enrollments, Court-approved attorneys' fees and costs, and Service Awards. The amounts below show the per-benefit caps and the requested fees and awards.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Cash Payment A requires documentation and is capped at $4,500 per claimant, including up to $100 for lost time; the Notice does not state an aggregate cap on total Cash Payment A claims. Cash Payment B requires no documentation and pays a flat $75 per claimant. Attorneys' fees, Service Awards, and notice and administration costs are paid by Parks Heritage separately and do not reduce the amounts available to Class Members.
Common questions
How much money will I receive?
Class Members can choose between two cash options. Cash Payment A reimburses actual, documented out-of-pocket losses caused by the Data Security Incident and incurred between July 17, 2024 and September 8, 2026, up to $4,500, which can include up to four hours of lost time at $25 per hour (capped at $100, subject to the overall $4,500 cap). Cash Payment B is a one-time $75 cash payment with no proof required. You may claim only one of Cash Payment A or Cash Payment B, not both. All Class Members can also enroll in two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance.
Do I need to submit proof of purchase?
Documentation is required for Cash Payment A. You must submit proof, such as bank statements or receipts, showing how much you spent or lost because of the Data Security Incident. Personal notes or statements alone are not enough to make a valid claim, though they can support other documentation. You cannot claim expenses that have already been reimbursed by a third party. Cash Payment B, the $75 flat payment, requires no documentation.
What if I didn’t receive a notice?
If you believe your private information was compromised in the Parks Heritage data security incident but did not receive a notice, you can still visit ParksHeritageDataIncident.com or call 1-833-421-7241 to confirm whether you are a Class Member and submit a Claim Form by the deadline.
Does staying in the class affect my right to sue later?
Yes. Unless you mail a written Request for Exclusion postmarked by August 7, 2026, you stay in the Class and release your right to sue Parks Heritage over the claims resolved in this lawsuit. The full release language is in Section IX of the Settlement Agreement, available at ParksHeritageDataIncident.com.
When will payments be sent out?
The Court will hold the Final Approval Hearing on November 2, 2026 at 9:30 a.m. Eastern Time, held virtually via Microsoft Teams. Payments are issued only after the Court grants final approval and any appeals are resolved, which can take a year or more. No action is required after a valid Claim Form is submitted; check ParksHeritageDataIncident.com for updates.
