- You lived at The Reserve at LaVista Walk on November 10, 2023, the date of the fire. Adults and minors are both included.
- You can provide proof of residency, such as a lease, rent receipt or ledger, or a utility bill for the unit.
- Your notice includes the LoginID and PIN used to file a claim online.
- Excluded: Charnelle Gunn, Robert Stokes, and anyone who already settled, assigned, or obtained a final judgment on their claims related to the Fire.
- Excluded: Anyone who requests exclusion by the November 22, 2026 deadline.

What happened
The lawsuit concerns a fire on November 10, 2023 at The Reserve at LaVista Walk, an apartment complex in Atlanta, Georgia. Residents who were living at the complex that day sued the companies that owned and managed the property, seeking compensation for being displaced from their homes and for personal property that was lost or damaged in the fire.
The Defendants deny any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The $8,450,000 settlement fund pays class member benefits as well as attorneys' fees, litigation costs, administration expenses, any service awards, and taxes.

1. Confirm you are eligible
You qualify if you lived at The Reserve at LaVista Walk on November 10, 2023. Every claim requires proof of residency, such as a lease or rental agreement, a rent receipt or ledger, or a utility bill for the unit. If you are unsure, call the Settlement Administrator at (833) 421-7358.

2. Choose your benefits
Adults can claim an equal share of the $1,300,000 Displacement Pool, with the per-person amount depending on how many valid adult claims are filed. Adults can also claim a pro rata share of the Property Loss Pool for personal property that was lost or damaged; these claims are reviewed individually and reduced by any insurance you already received. Each eligible child under 18 receives a flat $2,500 covering both displacement and property loss.

3. File online, by email, or by mail
Submit your claim at the official claim portal by November 22, 2026, or send a Claim Form by email or U.S. mail to LaVista Fire Settlement, P.O. Box 25191, Santa Ana, CA 92799 by that date. The online form requires the LoginID and PIN printed on your notice. Property loss claims need supporting records, such as receipts, invoices, or bank and credit card records. Documents are posted at LaVistaFireSettlement.com.

4. Receive your benefits
Payments are sent only after the Court grants final approval at the January 5, 2027 Final Approval Hearing, any appeals are resolved, and claims are processed.

The Final Approval Hearing is scheduled for January 5, 2027 at 1:30 p.m. ET at the U.S. District Court for the Northern District of Georgia, 75 Ted Turner Drive SW, Atlanta, GA 30303. The Court will also consider Class Counsel's request for attorneys' fees, costs, and service awards, which are paid from the settlement fund. Opt-out requests must be postmarked or emailed, and objections submitted, by November 22, 2026. The Court may move the hearing, so check LaVistaFireSettlement.com for updates before traveling.
Where the money is going
The Defendants will pay $8,450,000 into the settlement fund. After court-approved attorneys' fees, litigation costs, administration expenses, any service awards, and taxes are deducted, the remainder is split into a $1,300,000 Displacement Pool shared equally among adult claimants and a Property Loss Pool distributed pro rata based on recognized losses. Eligible children receive a flat $2,500 each. Because adult payments are shared, the final amount per claimant depends on how many valid claims are filed.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Displacement payments are an equal share of a fixed pool and property loss payments are pro rata, so individual amounts depend on the number of valid claims and the losses recognized.

What if I didn’t receive a notice?
The online claim form requires the LoginID and PIN printed on the notice. If you lived at the complex on November 10, 2023 but did not receive a notice, contact Simpluris at (833) 421-7358 or info@LaVistaFireSettlement.com before the November 22, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up your right to sue the Defendants and the other released parties about claims related to the Fire, whether or not you file a claim. To keep those rights, you must request exclusion by November 22, 2026.
When will payments be sent out?
Payments are sent only after the Court grants final approval at the January 5, 2027 Final Approval Hearing, any appeals are resolved, and claims are processed. An appeal can add a year or more to that timeline.
