What happened

This lawsuit alleges that Simplilearn Americas, Inc. disclosed users' personally identifiable information (PII), including information identifying video content they viewed on the Simplilearn Platform, to third parties without consent. Plaintiffs claim this conduct violated the Video Privacy Protection Act (VPPA), 18 U.S.C. § 2710, which protects consumers from having their video-viewing histories shared without permission. The case is pending in the Circuit Court of the Eleventh Judicial Circuit in Miami-Dade County, Florida.

Simplilearn denies the allegations and denies that it violated any law, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation.

Where the money is going

Simplilearn agreed to pay $3,000,000 into a settlement fund. Attorneys' fees and expenses, service awards, and notice and administration costs are paid from the fund before the remainder is divided pro rata among class members who file valid claims.

Total settlement fund $3,000,000

Less: Service awards ($2,500 × 2 reps) Up to $5,000

The fee and service award figures are from third-party settlement reports and should be confirmed against the official Notice on the settlement website.

Common questions

How much money will I receive?

The settlement does not set a fixed per-person amount. After fees, expenses, service awards, and administration costs are paid, the remaining fund is divided pro rata (equally) among class members who file valid claims. The exact amount depends on how many valid claims are filed.

Do I need to submit proof of purchase?

No documentation is required. On the Claim Form you declare, under penalty of perjury, that you accessed or used the Simplilearn Platform while in the United States between February 26, 2023 and September 16, 2026. Claims may be subject to audit and verification.

What if I didn’t receive a notice?

You can still file a claim if you did not receive a notice, as long as you meet the class definition. Get claim instructions and more information from the settlement website directly at SimplilearnPrivacySettlement.com, or contact the Settlement Administrator at 888-808-2849.

Does staying in the class affect my right to sue later?

If you stay in the Settlement Class (that is, you do not exclude yourself), you will release claims against Simplilearn arising from the allegations in this case, including VPPA claims, whether or not you file a claim. To keep your right to sue Simplilearn over these issues, you must exclude yourself by December 15, 2026. See the Notice on the settlement website for the full release.

When will payments be sent out?

Payments are expected after the Final Approval Hearing, anticipated in January 2027, and after any appeals are resolved. This can take a few months, or longer if there is an appeal.
