What happened
The lawsuit alleges that Southern Illinois Healthcare Enterprises, Inc., Southern Illinois Hospital Services, and Southern Illinois Medical Services, NFP used third-party tracking technologies, called tracking pixels, on the MyChart patient portal and Health Risk Assessment web pages in a way that violated certain privacy laws. Plaintiff filed Doe v. Southern Illinois Healthcare Enterprises, Inc., Case No. 2023LA55, in the Circuit Court of Williamson County, Illinois. The Court has defined the Class as approximately 79,215 U.S. patients who signed into Defendants' MyChart patient portal, scheduled appointments through MyChart or website open scheduling, or completed a Health Risk Assessment during specified periods between November 2, 2020 and July 6, 2023.
Southern Illinois denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, disruption, and time of continued litigation. Under the Settlement, Southern Illinois will pay a $17.50 cash payment to each Class Member who submits a valid and timely Claim Form, and will enroll Class Members in one year of CyEx Privacy Shield Pro, with attorneys' fees and the Class Representative service award paid separately by Southern Illinois without reducing the amount available to Class Members.

Where the money is going
There is no common settlement fund. Southern Illinois pays $17.50 to each Class Member who submits a valid and timely Claim Form, on a per-claim basis, and separately pays for one year of CyEx Privacy Shield Pro for Class Members who enroll. Class Counsel's request for attorneys' fees and costs of up to $625,000.00 and the Class Representative service award of up to $3,500.00 are paid separately by Southern Illinois and do not reduce the amount available to Class Members.
All amounts listed above are subject to final court approval at the August 24, 2026 Final Approval Hearing. The Court may award less than the amounts requested. Per the Settlement, none of the attorneys' fees, costs, or service award reduce the $17.50 cash payment or the Privacy Shield Pro benefit available to any Class Member.
