ZK Technology LLC has agreed to a $635,160 settlement over allegations that it required Illinois workers to scan a finger or face on a biometric timeclock without first obtaining written consent or providing the disclosures the Illinois Biometric Information Privacy Act (BIPA) requires. People who scanned a finger or face on a ZK Technology timeclock while working in Illinois between September 2020 and August 12, 2026 can file a claim by November 10, 2026. The notice estimates each approved claimant will receive between $800 and $2,000, with $2,000 as the cap.

Do you qualify?
You are a Class Member if ALL of the following apply:
- You scanned your finger or your face on a finger-scan or face-scan timeclock while working for ZK Technology LLC in Illinois.
- The scanning happened between September 2020 and August 12, 2026.
- You were not given written notice and did not sign a written release consenting to the collection of your biometric data before the scanning began.
- No pay stubs, time records, or other documents are required. You confirm your own employment and scanning on the Claim Form.
- Excluded: Anyone who timely opts out of the Settlement, and anyone who already released these BIPA claims through a prior settlement or agreement.

What happened
This class action was filed in the Chancery Division of the Circuit Court of Cook County, Illinois, alleging that ZK Technology LLC violated the Illinois Biometric Information Privacy Act. BIPA requires a private company to give written notice, explain the specific purpose and retention schedule, and obtain a signed written release before it collects a person's fingerprint, handprint, faceprint, or other biometric identifier. The complaint alleges that ZK Technology had Illinois workers clock in and out by scanning a finger or a face without completing those steps. BIPA allows statutory damages of $1,000 per negligent violation and $5,000 per reckless or intentional violation.
ZK Technology denies the allegations and denies that it violated BIPA, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and risk of continued litigation. The $635,160 Settlement Fund is non-reversionary, so every dollar remaining after Court-approved fees, costs, and the service award is distributed to workers who file valid claims, up to a $2,000 cap per person.

1. Confirm you are eligible
You qualify if you scanned a finger or a face on a ZK Technology timeclock while working in Illinois between September 2020 and August 12, 2026, without having signed a written biometric consent first. If the Settlement Administrator mailed or emailed you a notice, you have already been identified from the company's records as a likely Settlement Class Member.

2. Know what you will receive
The $635,160 Settlement Fund is divided into equal pro rata shares among everyone who files a valid claim, after deducting attorneys' fees (up to 38% of the fund), litigation costs, notice and administration costs, and a service award of up to $5,000 to the Class Representative. The notice estimates each approved claimant will receive between $800 and $2,000. No individual payment can exceed $2,000, so if very few people file, the surplus does not inflate individual checks beyond that cap.

3. File online or by mail
File online at ZKBIPASettlement.com by November 10, 2026, or mail a paper Claim Form (postmarked by November 10, 2026) to: Roman v. ZK Technology LLC, c/o Settlement Administrator, P.O. 4. Receive your payment
Payments go out after the Court grants final approval at the November 23, 2026 hearing and the judgment becomes final, including the resolution of any appeals. No follow-up is needed once your Claim Form is accepted.

The Final Approval Hearing is scheduled for November 23, 2026 at 9:30 a.m. Central in Courtroom 2601 of the Circuit Court of Cook County, 50 West Washington Street, Chicago, IL 60602, with a Zoom option. The date or time may change without further notice, so check ZKBIPASettlement.com before attending. The opt-out and objection deadline is October 23, 2026, about two and a half weeks before the claim deadline.
Where the money is going
This is a non-reversionary common fund. Attorneys' fees, litigation costs, notice and administration costs, and the service award all come out of the $635,160 before per-claimant shares are calculated. Each approved claimant receives an equal pro rata share of what remains, subject to a hard $2,000 per-person cap.
All amounts listed above are pending and subject to final court approval at the November 23, 2026 Final Approval Hearing. The Court may award less than the amounts requested. The estimated amount available to class members is Dapeer Law's arithmetic from the stated fee cap and service award, before notice and administration costs, which the notice does not break out separately.

How much money will I receive?
The notice estimates between $800 and $2,000 per approved claimant, with $2,000 as a hard cap. The actual figure is an equal pro rata share of the $635,160 fund after attorneys' fees (up to 38%), litigation costs, administration costs, and a service award of up to $5,000. The more workers who file, the smaller each share, and because of the cap the per-person amount cannot rise above $2,000 no matter how few people participate.
Do I need to submit proof of purchase?
No. You do not need pay stubs, time records, or any other documentation. ZK Technology's own records identify the Illinois workers who used the biometric timeclocks, and the Administrator sent notices to the people on that list. The Claim Form asks you to confirm your identity and that you scanned a finger or face on a company timeclock during the covered period.
What if I didn’t receive a notice?
You may still be a Class Member. If you scanned a finger or face on a ZK Technology timeclock while working in Illinois between September 2020 and August 12, 2026, call the Settlement Administrator at 888-406-0864 or email info@ZKBIPASettlement.com to check whether you are on the class list, then file online or by mail by November 10, 2026.
Does staying in the class affect my right to sue later?
Yes. Unless you submit a signed exclusion request postmarked or submitted online by October 23, 2026, you will be bound by the Settlement and will release your BIPA claims against ZK Technology arising from the biometric timeclock scanning, whether or not you file a claim. Given that BIPA provides statutory damages of $1,000 to $5,000 per violation, anyone with an unusually large number of scans may want to talk to their own lawyer before the opt-out date.
When will payments be sent out?
Payments are issued after the Court grants final approval at the November 23, 2026 hearing and the judgment becomes final. If anyone appeals, that can add a year or more. No action is needed after you file; monitor ZKBIPASettlement.com for updates.
