What happened
Plaintiff Sean Begaye alleges that 505 Quick Cash & Pawn's pawn ticket did not comply with the New Mexico Pawnbrokers Act, that in some transactions Quick Cash charged an illegally high pawn service charge, and that in some transactions, after default, Quick Cash sold pawned property for more than was owed, leaving a surplus that was not returned.
Quick Cash denies these allegations and denies any liability or wrongdoing, and the Court has not decided who is right. The parties settled as a compromise of disputed claims. Beyond cash, Quick Cash will forgive any pawn loan still owing and will request deletion of related credit reporting. Unredeemed property that Quick Cash has not sold is forfeited to Quick Cash.

Where the money is going
Quick Cash agreed to pay $400,000. After Court-approved attorneys' fees, gross receipts tax, litigation costs, administration costs, and a service award, about $289,526.75 remains for Class Members, divided based on damages with a $20 minimum check. Unclaimed funds go to a second distribution if economically practical, and any remainder goes to the New Mexico Center on Law and Poverty, subject to Court approval. None of the money reverts to Quick Cash.
All amounts listed above are pending and subject to final court approval at the Final Fairness Hearing. The Court may award less than the amounts requested. Individual payments above the $20 minimum depend on each Class Member's alleged overcharge or surplus.
