What happened

The lawsuit concerns a targeted cyberattack on Red Coats, Inc.'s systems in May 2025. According to the settlement website, files accessed in the incident contained names, addresses, Social Security numbers, and driver's license numbers. Plaintiffs allege Red Coats failed to adequately protect this information.

Red Coats has not admitted wrongdoing, and the Court has not decided who is right. Both sides agreed to settle to avoid the cost and risk of a trial. Settlement benefits are paid per valid claim, and Class Counsel's requested attorneys' fees, costs, and service awards are paid by Red Coats separately.

Where the money is going

This is a claims-made settlement with no fixed common fund stated on the settlement website. Red Coats pays benefits to class members who submit valid claims, and it pays Class Counsel's attorneys' fees and costs and the service awards separately, so those amounts do not reduce class member benefits.

Settlement fund Claims-made, no fixed fund
Ordinary out-of-pocket losses, per claimant Up to $2,000
Extraordinary losses, per claimant Up to $3,000
Attested lost time (4 hours at $25) Up to $100
Credit monitoring and fraud insurance 1 year
Attorneys' fees and costs (paid separately by Red Coats) Up to $200,000
Service awards (2 class representatives, paid separately) $1,500 each
Notice and administration costs To be set by Court

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Reimbursements are paid only for valid, documented claims within the stated caps.

Common questions

How much money will I receive?

It depends on your losses. You can claim up to $2,000 for documented ordinary losses, up to $3,000 for documented extraordinary losses from identity theft or fraud, up to $100 for attested lost time, and one year of credit monitoring. These are caps, not guaranteed amounts.

Do I need to submit proof of purchase?

Loss reimbursement requires supporting documentation, and personal declarations alone do not count. Attested lost time requires only a brief description of the time spent, and credit monitoring requires no proof.

What if I didn’t receive a notice?

The class includes all persons who were sent written notification of the Data Incident. If you believe you received a Red Coats data incident letter but did not get a settlement notice, call (833) 360-6781 or email info@RedCoatsSettlement.com before the January 7, 2027 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you cannot sue Red Coats separately over the claims released in the settlement, whether or not you file a claim. To keep those rights, you must mail an opt-out request by December 8, 2026.

When will payments be sent out?

Payments go out only after the Court grants final approval at the January 4, 2027 Final Approval Hearing and any appeals are resolved. An appeal can add a year or more to that timeline.
