What happened
The lawsuit concerns a criminal third party's unauthorized access to the network of Baptist Health Medical Center-Drew County between approximately April and July 2024. According to the settlement website, the information that may have been involved includes some combination of names, addresses, dates of birth, diagnoses and treatment information, and provider names. Plaintiffs allege that Baptist Health failed to adequately protect this information.
Baptist Health denies that it did anything wrong and denies all allegations, claims, wrongdoing, and liability, and the Court has not decided who is right. The parties agreed to settle to avoid the costs, risks, disruptions, and uncertainties of continuing the litigation. Class Counsel's attorneys' fees, costs, and service awards are paid by Baptist Health and are not charged to class members.

Common questions
How much money will I receive?
It depends on what you claim. All class members can get two years of credit monitoring. You can also claim up to $80 for lost time and either up to $400 in ordinary documented losses or up to $4,000 in documented identity theft or fraud losses. Payments depend on the Court granting final approval.
Do I need to submit proof of purchase?
Credit monitoring requires only a valid claim. Out-of-pocket and identity theft loss claims require receipts or other documentation, and self-prepared notes alone are not enough. Check the Claim Form for what is required for lost time.
What if I didn’t receive a notice?
Class membership is based on whether your information was potentially impacted in the Data Incident. If you think you were affected but did not receive a notice or LoginID and PIN, contact Simpluris at (866) 606-0682 or info@BHSettlement.com before the December 8, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to sue Baptist Health and the Released Parties over the Released Claims described in Section XI of the Settlement Agreement, whether or not you file a claim. To keep those rights, you must exclude yourself by November 9, 2026.
When will payments be sent out?
Payments are distributed after the Court grants final approval at the February 4, 2027 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
