- Your Private Information was potentially accessible as a result of the Data Incident at Wayne Memorial Hospital discovered on or around June 3, 2024.
- Notices about the Data Incident were sent on or around August 27, 2025. Your notice includes a Unique ID and Passcode used to file a claim.
- Excluded: Directors and officers of Wayne Memorial Hospital, governmental entities, and the assigned judge, the judge's immediate family, and court staff.
- Excluded: Anyone who opts out of the settlement by the November 7, 2026 deadline.

What happened
The lawsuit concerns a data incident at Wayne Memorial Hospital in Jesup, Georgia. According to the settlement notice, unauthorized third parties potentially gained access to the hospital's computer systems from approximately May 30, 2024 to June 3, 2024, and the hospital discovered the incident on or around June 3, 2024. Plaintiffs allege the hospital was negligent in failing to prevent the Data Incident.
Wayne Memorial Hospital denies any wrongdoing, and by entering into the settlement it is not admitting any wrongdoing. No court has determined that any law was violated. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. This is not a fixed-fund settlement: benefits are paid on valid claims, and the alternate cash payments are capped at $300,000 in total.

2. Choose your benefits
Choose Cash Payment A, reimbursement of up to $5,000 for documented losses from fraud or identity theft, or Cash Payment B, an alternate cash payment estimated at $25 that requires no documentation. Cash Payment B is capped at $300,000 in total and will be reduced pro rata if claims exceed that amount. The notice also describes two years of single-bureau credit monitoring with $1,000,000 of identity theft insurance.

3. File online or by mail
Submit your claim online at the official claim portal by December 7, 2026, or mail a paper Claim Form postmarked by that date to CPT Group, Inc., PO Box 19504, Irvine, CA 92623. The online portal asks for the Unique ID and Passcode printed on your notice. Cash Payment A requires reasonable documentation; a personal certification alone is not enough. 4. Receive your benefits
Payments are issued after the Court grants final approval at the January 27, 2027 Final Approval Hearing and the settlement becomes final, including resolution of any appeals. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for January 27, 2027 at 1:30 p.m. ET in the Superior Court of Wayne County, 174 N. Brunswick Street, Jesup, GA 31546. The Court will decide whether the settlement is fair, reasonable, and adequate, and will consider Class Counsel's request for attorneys' fees and costs and the service awards. Opt-out requests and objections must be postmarked by November 7, 2026. The Court may move the hearing, so check WMHDataSettlement.com for updates before traveling.
Where the money is going
This is a claims-made settlement, not a fixed common fund. Wayne Memorial Hospital pays valid claims for documented losses of up to $5,000 each, and alternate cash payments estimated at $25 each, which are capped at $300,000 in total and reduced pro rata if claims exceed the cap. According to the notice, the hospital covers settlement administration costs.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The $25 alternate cash payment is an estimate and may be reduced pro rata if total Cash Payment B claims exceed $300,000.

Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up any right to sue Wayne Memorial Hospital over the claims released by the settlement related to the Data Incident, whether or not you file a claim. To keep those rights, you must opt out with a request postmarked by November 7, 2026.
When will payments be sent out?
Payments are made after the Court approves the settlement at the January 27, 2027 Final Approval Hearing and the settlement becomes final. If there is an appeal, payments can be delayed by a year or more.
