What happened

The lawsuit alleges that USC Arcadia Hospital used tracking technologies on its website that shared information about website users with Meta and other third parties. The settlement covers people who completed a form on the hospital's website to sign up for email or event updates between February 1, 2022 and January 31, 2023. The claims include alleged violations of the California Confidentiality of Medical Information Act (Civil Code section 56) and the California Invasion of Privacy Act (Penal Code sections 631 and 637).

USC Arcadia Hospital denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The settlement does not release medical malpractice or other bodily injury claims.

How to file a claim

  • 1. Confirm you are eligible

You qualify if you completed a form on the USC Arcadia Hospital website to sign up for email or event updates between February 1, 2022 and January 31, 2023. If you received a notice, you are identified as a class member. If you are unsure, call the Settlement Administrator at (844) 496-0567.

  • 2. Understand your benefits

Class members who submit a valid claim receive an equal pro rata share of the Net Settlement Fund, which is the $200,000 fund minus Court-approved attorneys' fees and expenses, administration costs, and any service award. The exact amount depends on how many valid claims are filed. Separately, every class member can activate one year of CyEx Privacy Shield Pro, a dark web monitoring service, without filing a claim, using the code in the notice. Activation is due by March 15, 2027.

  • 3. File online or by mail

Submit your claim online at the official claim portal by December 7, 2026, or mail a paper Claim Form postmarked by that date to Merle v. USC Arcadia Hospital, c/o Settlement Administrator, P.O. CyEx enrollment instructions and the notice are posted at USCArcadiaHospitalSettlement.com.

  • 4. Receive your payment

Where the money is going

USC Arcadia Hospital will pay $200,000 into a settlement fund. The fund pays Court-approved attorneys' fees and expenses, administration costs (including CyEx activation codes), and any service award first. What remains, the Net Settlement Fund, is divided in equal pro rata shares among class members who submit valid claims. Any leftover money goes to The Los Angeles Trust for Children's Health.

Total settlement fund $200,000
Cash payment, per claimant Equal pro rata share
CyEx Privacy Shield Pro (no claim needed) 1 year
Less: Attorneys' fees requested $61,335.92
Less: Litigation expenses requested $15,992.25
Less: Service award (Named Plaintiff) $1,500
Less: Notice & administration costs To be set by Court

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The per-claimant cash amount depends on the number of valid claims and the funds remaining after deductions. Any unclaimed funds go to The Los Angeles Trust for Children's Health as cy pres.

Common questions

How much money will I receive?

Each class member who files a valid claim receives an equal pro rata share of the Net Settlement Fund, which is what remains of the $200,000 fund after fees, expenses, administration costs, and any service award. The settlement website does not state an estimated amount. All class members can also activate one year of CyEx Privacy Shield Pro.

Do I need to submit proof of purchase?

No proof is required. You only need to submit a valid Claim Form by December 7, 2026. The online form uses the LoginID and PIN printed on your notice.

What if I didn’t receive a notice?

If you completed a form on the USC Arcadia Hospital website to sign up for email or event updates between February 1, 2022 and January 31, 2023 but did not receive notice, email info@USCArcadiaHospitalSettlement.com with your full name and mailing address to request a LoginID and PIN, or call (844) 496-0567, before the December 7, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you give up the right to sue USC Arcadia Hospital separately over the claims in this lawsuit, including claims under Civil Code section 56 and Penal Code sections 631 and 637, whether or not you file a claim. Medical malpractice and other bodily injury claims are not released. To keep your rights, you must exclude yourself by December 7, 2026.

When will payments be sent out?

Payments are distributed after the Court grants final approval at the December 14, 2026 Final Fairness Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
