What happened

Washington's Equal Pay and Opportunities Act (RCW 49.58.110) requires employers to include the wage scale or salary range in job postings. Plaintiff Steven Perry alleged that Boeing's Washington job postings consistently omitted this required pay information, leaving applicants without the wage transparency the law is designed to provide. Plaintiff contended that these omissions affected thousands of applicants across the class period.

Boeing denies the allegations and denies any wrongdoing or liability. The parties agreed to settle to avoid the cost, uncertainty, and time of continued litigation. The settlement also covers Boeing Financial Corporation.

Where the money is going

The settlement fund ranges from $5,235,990 to $8,044,000 depending on how many class members submit valid claims. All eligible claimants who file timely claims receive an equal share of the net fund after attorneys' fees, the service award, and administration costs are deducted.

Total settlement fund (variable) $5.2M–$8M
Less: Attorneys' fees & expenses (requested) $2,372,980
Less: Service award (class representative) Up to $20,000
Less: Notice & administration costs To be set by Court
Available for class members (estimated) ~$1,396 per claimant

The per-claimant amount is an estimate based on projected claim rates. The actual payment is an equal share of the net fund divided by the number of valid claims filed. If more people file than projected, the per-person amount will be lower; if fewer file, it could be higher. All amounts are subject to final court approval.
