Enterprise Leasing Company of Florida, LLC agreed to a $1.8 million monetary settlement to resolve a lawsuit brought by the U.S. Equal Employment Opportunity Commission alleging a pattern or practice of age discrimination in hiring for Management Trainee positions in Florida. Individuals who applied for and were denied a Management Trainee position in Florida between January 1, 2019 and December 31, 2023, and were age 40 or older at the time, may be eligible for a share of the relief by submitting a Claimant Questionnaire by June 8, 2026. Enterprise Florida denies the allegations and denies that it violated the Age Discrimination in Employment Act.

  • You applied for a Management Trainee position with Enterprise Leasing Company of Florida, LLC in Florida at any time between January 1, 2019 and December 31, 2023.
  • You were age 40 or older at the time you applied for the Management Trainee position.
  • You were not hired for the Management Trainee position you applied for.
  • No documentary proof of application is required at the questionnaire stage. The Claimant Questionnaire asks you to confirm eligibility under oath.
  • Excluded: Individuals who were hired into the Management Trainee position they applied for during the class period.
  • Excluded: Applicants for Management Trainee positions outside the State of Florida, or for positions other than Management Trainee.
  • Excluded: Applicants who were under age 40 at the time they applied.

What happened

In September 2023, the U.S. Equal Employment Opportunity Commission filed a lawsuit alleging that Enterprise Leasing Company of Florida, LLC engaged in a pattern or practice of age discrimination by failing to hire applicants age 40 and over for Management Trainee positions in Florida between January 1, 2019 and December 31, 2023, in violation of the Age Discrimination in Employment Act of 1967 (ADEA). The EEOC sought monetary relief on behalf of affected applicants and prospective relief to address the company's hiring practices.

Enterprise Florida denies the allegations in the Complaint and denies that it violated the ADEA. The parties resolved the case through a monetary settlement of $1.8 million and an agreement to engage in collaborative efforts to further strengthen Enterprise Florida's hiring practices. Because this is a federal government enforcement action brought by the EEOC, there is no opt-out process and no separate Final Fairness Hearing; individuals who were age 40 or older when they applied and were not hired participate by submitting a Claimant Questionnaire to the Settlement Administrator.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you applied for and were denied a Management Trainee position with Enterprise Leasing Company of Florida, LLC in Florida at any time between January 1, 2019 and December 31, 2023, and you were age 40 or older when you applied. If you received a Notice in the mail or by email from Simpluris, you have been identified as a potential Claimant and were sent a Unique ID and PIN for the online Questionnaire.

  • 2. Understand the payout

    The $1.8 million monetary settlement is allocated by the EEOC among eligible Claimants who timely submit a complete and verified Claimant Questionnaire. The EEOC determines individual award amounts after the questionnaire deadline based on factors set out in the settlement, including the number of qualifying Claimants. No claimant is guaranteed a specific dollar amount; payments are pro rata across the eligible group.

  • 3. Submit the Claimant Questionnaire online, by email, or by mail

    Submit your Claimant Questionnaire online at eeoc-enterprisesettlement.com/form/claim using the Unique ID and PIN from your Notice. You may also submit by email to info@EEOC-EnterpriseSettlement.com or by mail (postmarked by June 8, 2026) to: EEOC v. Enterprise Leasing Company of Florida LLC, c/o Settlement Administrator, P.O. Box 26170, Santa Ana, CA 92799. If you lost your Unique ID and PIN or did not receive a Notice but believe you are a Claimant, contact the Settlement Administrator to request login credentials.

  • 4. Receive notification of your award

    Do not expect to receive notification of any monetary award for at least three months after the June 8, 2026 questionnaire deadline. If the EEOC determines you are eligible for an award, the Settlement Administrator will send a second notification that includes a release of claims and a W-9 you must sign and return before any payment is issued. No action is required during this review period.

This is a federal government enforcement action brought by the EEOC, not a private class action. There is no opt-out process and no separate Final Fairness Hearing. Where the money is going

The $1.8 million monetary settlement is paid directly by Enterprise Florida and distributed by the Settlement Administrator under the EEOC's direction. Because this is a government enforcement action, attorneys' fees and litigation costs are absorbed by the EEOC and the parties separately and are not deducted from the $1.8 million available to Claimants. The EEOC determines individual award amounts based on the number and circumstances of eligible Claimants who timely submit a verified Claimant Questionnaire.

You will need to provide the Unique ID and PIN from your Notice; if you did not receive one, contact the Settlement Administrator to request credentials.

What if I didn’t receive a notice?

You can still submit a Claimant Questionnaire if you did not receive a Notice. If you applied for a Management Trainee position with Enterprise Florida in Florida between January 1, 2019 and December 31, 2023, and were age 40 or older at the time, contact the Settlement Administrator at info@EEOC-EnterpriseSettlement.com or 1-888-226-9018 to request a Unique ID and PIN. You can also submit a paper Claimant Questionnaire by mail (postmarked by June 8, 2026) to the Settlement Administrator at the address on the settlement website.

Does staying in the class affect my right to sue later?

Because this is a federal government enforcement action by the EEOC, there is no opt-out and no separate release at the questionnaire stage. Under 29 U.S.C. 626(c)(1), the filing of the EEOC's lawsuit terminated individuals' right to bring a new private civil action against Enterprise Florida under the ADEA for the failure-to-hire claims at issue. You may want to consult an attorney about any rights you have outside the scope of this lawsuit. If the EEOC later determines you are eligible for an award, you will be asked to sign and return a release of claims with the second notification before any payment is issued.

When will payments be sent out?

Do not expect notification of an award determination for at least three months after the June 8, 2026 questionnaire deadline. If you are determined eligible, a second notification will follow with a release of claims and a W-9 to sign and return; payment is issued after the Settlement Administrator receives and processes those signed documents.
