Nature's Path Foods Meal and Rest Break Settlement

Nature's Path Foods USA agreed to settle a class action lawsuit alleging it failed to compensate employees for missed and noncompliant meal and rest periods, in violation of Washington State law. What happened

Plaintiff Rick Weidkamp filed this class action on behalf of himself and other non-exempt hourly employees, alleging that Nature's Path Foods USA, Inc. violated Washington State law by failing to provide compensation for missed and noncompliant meal and rest periods. Washington law requires employers to provide paid rest breaks and unpaid meal periods and to compensate employees when those breaks are not properly provided.

Nature's Path Foods USA denies the allegations and denies any wrongdoing or liability. The parties agreed to settle to avoid the cost, risk, and time of continued litigation, and to provide class members with compensation now rather than years later.

How to file a claim

  • 1. Confirm you are eligible

    You must have worked as a non-exempt hourly employee for Nature's Path Foods USA, Inc. at any time between March 31, 2022 and March 31, 2026. If the company's records show you in the class, you should have received a notice by mail.

  • 2. Verify your mailing address

    No claim form is required. Payment will be mailed automatically to the address on file with the Settlement Administrator. If your address has changed or you did not receive a notice, contact the Settlement Administrator right away to update your information.

  • 3. Contact the administrator if needed

    If the Court approves the settlement at the August 7, 2026 Fairness Hearing and any appeals are resolved, eligible class members who did not exclude themselves will be mailed a check. Checks expire 120 days after issuance, so deposit promptly. Payment will be split: 40% as wages (W-2) and 60% as damages and penalties (1099).

Where the money is going

The total settlement fund has not been publicly disclosed in the available materials. Attorneys' fees of $465,000, costs of $15,000, and a $25,000 service award for the class representative are subject to Court approval and will be paid from the gross settlement amount before class member payments are calculated.

Does staying in the class affect my right to sue later?

If you do not exclude yourself, you give up the right to sue Nature's Path Foods USA for the wage-and-hour claims covered by this settlement for the class period. To preserve your right to bring your own lawsuit, you must submit a written opt-out request postmarked by July 13, 2026 to the Settlement Administrator. If you opt out, you will not receive a payment.

When will payments be sent out?

Payments will be issued after the Court grants final approval at the August 7, 2026 Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. All checks expire 120 days after issuance, so deposit yours promptly when it arrives.
