Calibrated Healthcare Data Breach Class Action Settlement
Calibrated Healthcare Systems, LLC and Calibrated Healthcare, LLC agreed to a $1.75 million settlement over a February 2024 data breach that exposed the personal and medical information of roughly 34,562 patients. All Settlement Class Members will automatically receive two years of free identity theft and medical monitoring services plus a cash payment between $21.44 and $28.68. Class members who experienced out-of-pocket losses or spent time addressing breach-related issues can also file a claim for up to $5,175 in additional compensation. The claim deadline is July 9, 2026.

- You received a written notice from Calibrated Healthcare about the alleged Data Breach, which indicates you have been identified as a potential Settlement Class Member.
- Excluded: Excluded from the Settlement Class are: the judges presiding over this action and their families and staff; Calibrated Healthcare and its subsidiaries, parent companies, successors, predecessors, affiliates, and current or former officers and directors; individuals who timely and properly submit a Request for Exclusion; and any person found guilty of criminal activity related to the Data Breach.

What happened
On or about February 26, 2024, Calibrated Healthcare became aware that unauthorized parties had accessed its computer network between February 25 and February 26, 2024. During that window, certain files containing patients' personally identifiable information (PII) and protected health information (PHI) were allegedly accessed, viewed, copied, and disclosed without authorization. The compromised information may include names, dates of birth, medical diagnosis and treatment information, health insurance information (including claims and billing data), and for some patients, Social Security numbers and driver's license numbers. Plaintiffs Brandi Adams and Trevor Holden filed this class action lawsuit alleging that Calibrated Healthcare failed to adequately protect patient information.
Calibrated Healthcare denies all allegations and denies any wrongdoing or liability. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation. As part of the settlement, Calibrated Healthcare has agreed to invest approximately $630,000 in enhanced security measures, including hiring a Chief Information Security Officer, additional cybersecurity analysts, updated servers, additional loss prevention systems, and multi-factor authentication across all network access points.

You must be one of the approximately 34,562 persons identified on the Settlement Class List whose confidential information may have been compromised in the Calibrated Healthcare data breach of February 2024. If you received a notice from Calibrated Healthcare about the breach, you are likely a Settlement Class Member.

2. Decide what to claim
Every Settlement Class Member automatically receives 2 years of Medical Shield Total by CyEx and a pro rata Monetary Payment between $21.44 and $28.68. No claim is needed for these. To receive additional cash, file a Claim Form: up to $175 for documented time spent addressing the breach (at $25/hour for up to 7 hours), and up to $5,000 for out-of-pocket losses traceable to the breach. Both require documentation such as bank statements, credit card records, invoices, or phone records.

4. Receive your benefits
After the Court grants final approval at the August 13, 2026 Fairness Hearing and any appeals are resolved, the Settlement Administrator will mail enrollment instructions for the Medical Monitoring and Identity Theft Insurance Services and a Monetary Payment to all Settlement Class Members. No follow-up is required after you submit your claim.

The Final Approval Hearing is scheduled for August 13, 2026 at 10:00 a.m. PT before the Honorable John W. Holcomb in Courtroom 9D, Ronald Reagan Federal Building and United States Courthouse, 411 West Fourth Street, Santa Ana, CA 92701. The Court may reschedule the hearing, so check CalibratedSettlement.com for updates before traveling.
Where the money is going
Calibrated Healthcare agreed to establish a non-reversionary settlement fund of $1,750,000 covering all class member benefits, attorneys' fees and costs, service awards to the two class representatives, and notice and administration expenses. Any residual funds after all approved claims are paid will be redistributed to class members who cashed their initial payments, or sent to a non-profit residual recipient.
All amounts are pending final court approval at the August 13, 2026 Fairness Hearing. The automatic Monetary Payment ($21.44 to $28.68) is pro rata and will be adjusted based on how much of the fund is used for Documented Time and Out-of-Pocket Costs claims. The Documented Time pool is capped at $100,000 and the Out-of-Pocket Costs pool is capped at $150,000.

How much money will I receive?
Every Settlement Class Member automatically receives two years of Medical Shield Total by CyEx (medical and identity theft monitoring) and a pro rata cash payment between $21.44 and $28.68. No claim form is required for these. If you also file a Claim Form by July 9, 2026, you may receive up to $175 for documented time spent addressing the breach ($25/hour for up to 7 hours) and up to $5,000 for documented out-of-pocket losses fairly traceable to the breach. The maximum additional recovery from a Claim Form is $5,175.
Do I need to submit proof of purchase?
No documentation is required to receive the automatic Monetary Payment or the two years of Medical Shield Total by CyEx. Documentation is required only if you are claiming a Documented Time Payment or Out-of-Pocket Costs reimbursement. For Documented Time, you must sign an attestation and provide records showing time spent (such as bank statements, invoices, or phone records). For Out-of-Pocket Costs, you must also sign an attestation and provide third-party documentation of the expenses incurred.
What if I didn’t receive a notice?
You may still be eligible even if you did not receive a notice. Contact the Settlement Administrator at info@CalibratedSettlement.com or (833) 386-6493 to determine whether you are on the Settlement Class List. If you lost your Unique ID Number and PIN, the Settlement Administrator can provide them so you can file your Claim Form online.
Does staying in the class affect my right to sue later?
By remaining in the Settlement Class, you give up the right to sue Calibrated Healthcare and related parties for all claims arising from the February 2024 data breach, including claims under California's CMIA, CCPA, UCL, CLRA, and Consumer Records Act, as well as negligence, invasion of privacy, breach of contract, and unjust enrichment. To preserve your right to sue separately, you must submit a timely Request for Exclusion postmarked no later than July 9, 2026.
When will payments be sent out?
Benefits will be distributed after the Court grants final approval at the August 13, 2026 Fairness Hearing and any appeals are resolved. The appeal process can extend the timeline by a year or more. The Settlement Administrator will mail enrollment instructions for the Medical Monitoring and Identity Theft Insurance Services and the Monetary Payment once the settlement becomes final.
