Cardiovascular Consultants Data Breach Class Action Settlement
Cardiovascular Consultants Ltd. agreed to a $3.85 million settlement over a September 2023 data breach that exposed patients' sensitive personal and medical information. What happened
On September 29, 2023, Cardiovascular Consultants Ltd. experienced a data breach to its computer systems in which sensitive personally identifiable information and protected health information may have been accessed and acquired. The compromised information included names, Social Security numbers, addresses, dates of birth, contact information, driver's license and state ID numbers, health insurance information, and medical information such as diagnoses and treatment details. Cardiovascular Consultants sent notice to impacted individuals beginning December 2, 2023. Plaintiffs Michele Stroup, Georgios Asimakopoulos, Dode Hammack, and John Gatchell filed this class action lawsuit alleging inadequate data security practices.
Cardiovascular Consultants denies all of the plaintiffs' claims and maintains that it did not do anything wrong. The parties agreed to settle to avoid the costs, risks, and uncertainty of continued litigation.

1. Confirm you are eligible
You must be a U.S. resident whose personal information was potentially compromised in the CVC data breach discovered in September 2023. Anyone who received a Notice of the Data Incident from Cardiovascular Consultants is included.

2. Gather documentation (for out-of-pocket claims)
No documentation is required to claim the estimated $75 pro rata cash payment or 2 years of medical monitoring. If you also want to claim reimbursement for out-of-pocket losses (up to $5,000), you will need third-party documentation such as credit card statements, phone bills, or credit monitoring receipts showing costs incurred on or after September 29, 2023 that are traceable to the breach.

4. Receive your payment
Benefits will be distributed after the Court grants final approval at the August 18, 2026 Fairness Hearing and any appeals are resolved. For Medical Monitoring, the Settlement Administrator will send an activation code after Final Approval. No follow-up is required after you submit your claim.

Where the money is going
Cardiovascular Consultants agreed to establish a non-reversionary settlement fund of $3,850,000 covering all class member benefits, attorneys' fees and costs, service awards to the four class representatives, and notice and administration expenses.
All amounts are pending final court approval. The individual benefits cap is $5,000 per class member. The estimated $75 cash payment may increase or decrease depending on the number of valid claims filed. If out-of-pocket loss claims exceed the net fund, those payments will be reduced pro rata and the medical monitoring period may be reduced to one year. If reimbursement for out-of-pocket losses depletes the fund, pro rata cash payments may not be made.
Common questions
How much money will I receive?
You can claim up to three benefits: (1) an estimated $75 pro rata cash payment (the final amount may increase or decrease based on the total number of valid claims filed); (2) reimbursement of documented, unreimbursed out-of-pocket losses up to $5,000 that are fairly traceable to the data breach; and (3) two years of free Medical Monitoring. The individual benefits cap is $5,000. No documentation is required for the cash payment or medical monitoring.
Do I need to submit proof of purchase?
Documentation is required only if you are claiming reimbursement for out-of-pocket losses. You will need third-party documentation such as credit card statements, phone bills, or identity theft protection receipts showing costs incurred on or after September 29, 2023. Self-prepared documents alone are not sufficient. You do not need any documentation to claim the estimated $75 cash payment or 2 years of medical monitoring.
What if I didn’t receive a notice?
You can still file a claim even if you did not receive a notice in the mail. Notice was sent to individuals whose personal information was potentially compromised in the breach, beginning December 2, 2023. If you believe your information may have been affected, visit CVCDataSettlement.com or call (833) 447-9408 to confirm eligibility and obtain a Claim Form.
Does staying in the class affect my right to sue later?
If you remain in the Settlement Class, you give up the right to sue, continue to sue, or be part of any other lawsuit against Cardiovascular Consultants about the legal claims resolved by this settlement. The opt-out deadline was June 1, 2026. If you did not submit a timely Request for Exclusion, you are bound by the settlement terms.
When will payments be sent out?
Benefits will be distributed after the Court grants Final Approval at the August 18, 2026 Fairness Hearing and any appeals are resolved. For the Medical Monitoring benefit, the Settlement Administrator will send an activation code to eligible class members who submitted a valid claim.
