What happened

Plaintiffs Dalit Cohen, Anastasia Kurtz, and Tina Scott filed this class action against eSupplements, LLC d/b/a Nutricost alleging the company violated consumer protection statutes and breached express and implied warranties by marketing and selling its Nutricost Magnesium Glycinate Supplements as containing 420 mg of magnesium "as magnesium glycinate" when, according to the plaintiffs, the supplements did not match that description. The lawsuit covers U.S. residents who purchased the 240-capsule or 120-capsule variants of the product during the class period.

Nutricost denies any wrongdoing and denies that it violated any state or federal law. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation.

How to file a claim

  • 1. Confirm you are eligible

    You must be a U.S. resident who purchased Nutricost Magnesium Glycinate Supplements in the 240-capsule or 120-capsule variant between February 1, 2021 and June 8, 2026.

  • 2. Tally up your claim

    If you received a notice with a Claim ID and PIN, you are entitled to one Award Unit per supplement purchased as reflected in Nutricost's sales records, up to $19.95 per unit. If you did not receive a Claim ID and PIN, you are still eligible but will receive one Award Unit total. All Award Units are equal in value and paid pro rata from the net settlement fund, so actual amounts depend on total valid claims filed.

  • 3. File online or by mail

    Submit your Claim Form online at secure.cohenmag.com by August 7, 2026, or mail a paper Claim Form (postmarked by August 7, 2026) to: Magnesium Supplement Settlement, c/o JND Legal Administration, PO Box 91237, Seattle, WA 98111. You can also obtain a Claim Form by calling 1-888-337-8438.

  • 4. Receive your payment

    Payments are issued after the Court grants final approval at the October 15, 2026 Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

Where the money is going

This is a non-reversionary common fund. Attorneys' fees (up to one-third of the fund), incentive awards to the three Class Representatives (up to $10,000 each), and notice and administration costs come out of the $1,835,000 before payments are calculated for class members.

All amounts listed above are pending and subject to final court approval at the Fairness Hearing. The Court may award less than the amounts requested. Each Award Unit has equal value not to exceed $19.95; if valid claims exceed the net fund, payments will be reduced on a pro rata basis.

Common questions

How much money will I receive?

Each valid Award Unit is worth up to $19.95, but the actual amount is pro rata. If you received a Claim ID and PIN, you get one Award Unit per supplement purchased as shown in Nutricost's records. Without a Claim ID and PIN, you receive one Award Unit total. The final per-unit payment depends on how many valid claims are filed across all class members.

Do I need to submit proof of purchase?

No documentation is required to submit a Claim Form. If you received a notice with a Claim ID and PIN, entering those will increase the number of Award Units you can claim (one per purchase on record). Without that information, you can still file and receive one Award Unit. See the Claim Form at secure.cohenmag.com for details.

What if I didn’t receive a notice?

Yes, you can still file even if you did not receive a direct notice. If you did not get a Claim ID and PIN, simply complete the Claim Form without them and you will receive one Award Unit. For help, call the Settlement Administrator at 1-888-337-8438 or visit CohenMAG.com.

Does staying in the class affect my right to sue later?

Yes. Unless you mail a written opt-out request postmarked by August 7, 2026 to the Settlement Administrator at Magnesium Supplement Settlement, c/o JND Legal Administration, PO Box 91237, Seattle, WA 98111, you will be bound by the Settlement and release any claims regarding the marketing, advertising, labeling, or sale of the Supplements against Nutricost and the Released Parties.

When will payments be sent out?

The Court will hold the Fairness Hearing on October 15, 2026. Payments will be issued after the Court grants final approval and any appeals are resolved. The appeal process can take a year or more. Once you submit a valid Claim Form, no further action is required. Check CohenMAG.com for updates.
