Thriveworks agreed to a $1.9 million settlement over allegations that its patient portal shared users' sensitive health information with Google and LinkedIn through tracking pixels -- without consent. What happened
Plaintiffs Jennifer Mosher and Lila Wakely filed this class action alleging that Thriveworks embedded third-party tracking technologies on its patient portal that transmitted users' sensitive personal and health-related information to Google and LinkedIn without their knowledge or consent. The lawsuit claims these disclosures violated the Florida Security of Communications Act (Fla. Stat. Section 934.03) and the federal Electronic Communications Privacy Act (18 U.S.C. Section 2511).
Thriveworks denies all allegations and denies any wrongdoing or liability. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation. As part of the settlement, Thriveworks has also agreed to review its website tracking software to ensure it is configured to prevent the collection of patient medical information without consent going forward.

4. Receive your payment
Payments are expected on or before October 10, 2026, after the Court grants final approval at the August 4, 2026 Fairness Hearing and any appeal period expires. Payment will be made by check, PayPal, or Venmo. Checks expire 180 days after issuance, so deposit promptly.

The Fairness Hearing is scheduled for August 4, 2026 at 8:30 a.m. before the Honorable Stacy Youmans at the Circuit Court for the Fifth Judicial Circuit, Marion County, Florida (110 NW First Avenue, Ocala, FL 34475), or virtually via Zoom. Where the money is going
Thriveworks agreed to pay up to $1,900,000 as an aggregate cap covering all class member cash payments, attorneys' fees (up to one-third of the fund), service awards to the two named plaintiffs (up to $2,500 each), and all notice and administration costs.
All amounts are pending final court approval. The $10 per-claimant cap applies to individual payments. If the total of valid claims exceeds the remaining fund after fees and costs, individual payments may be reduced on a pro rata basis.

How much money will I receive?
Each eligible class member can receive up to $10.00 in cash. No documentation is required. If the number of valid claims exceeds what remains of the fund after attorneys' fees, costs, and service awards, payments may be reduced proportionally.
Do I need to submit proof of purchase?
No documentation is required. You do not need to provide receipts, account numbers, or any other supporting records. Simply complete the Claim Form with your name and contact information.
What if I didn’t receive a notice?
You can still file a claim even if you did not receive a notice in the mail. Settlement notices were mailed starting May 22, 2026 to people identified in Thriveworks' records. If you used the patient portal during the class period and did not receive a notice, you may still be eligible. Visit ThriveworksPrivacySettlement.com or call (833) 386-6571 to confirm eligibility and get a Claim Form.
Does staying in the class affect my right to sue later?
If you stay in the class and the settlement is approved, you release Thriveworks and its affiliates from the claims resolved by this settlement, including claims under the FSCA and ECPA related to the tracking disclosures. If you want to preserve your right to sue independently, you must opt out by July 21, 2026 by mailing a written exclusion request to Thriveworks Privacy Settlement, ATTN: Exclusion Request, PO Box 25226, Santa Ana, CA 92799.
