Esse Health Data Breach Class Action Settlement

American Multispecialty Group, Inc. d/b/a Esse Health agreed to a $2,525,000 settlement over an April 2025 cyberattack that potentially exposed patients' names, Social Security numbers, dates of birth, health insurance information, and other personal and health information. Class Members who were notified of the Data Incident can enroll in two years of free medical identity protection and claim an estimated $50 pro rata cash payment, no proof required, by August 4, 2026.

  • Excluded: American Multispecialty Group, Inc. d/b/a Esse Health and its officers, directors, and related companies.
  • Excluded: The judge presiding over the case, and the judge's family and staff.

What happened

In late April 2025, Esse Health detected unusual activity on its computer network and later determined that an unauthorized party had potentially accessed personally identifiable information and protected health information. The information involved varied by individual and could have included names, addresses, dates of birth, health insurance information, Social Security numbers, Esse Health-assigned identification numbers (medical record number, person number, and person ID), and certain health information.

Esse Health denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if Esse Health's records identify you as potentially impacted by the April 2025 Data Incident, including anyone who received notice that their Private Information may have been compromised.

  • 2. Enroll in identity protection, and add a cash claim

    All Class Members can enroll in two years of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance. Class Members can also claim a one-time Pro Rata Cash Payment, currently estimated at $50 but subject to adjustment based on the total number of valid claims filed, with no proof or documentation required.

  • 3. File online or by mail

    Submit the Claim Form online at essehealthsettlement.com/form/claim by August 4, 2026, or mail a paper Claim Form (postmarked by August 4, 2026) to: Esse Health Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958. Medical Identity Protection enrollment codes were sent by email or postcard and can be activated at app.medicalshield.cyex.com/enrollment/activate/esse.

  • 4. Receive your benefits

    Medical Identity Protection activates once the Court grants final approval. Cash payments are issued after the Court grants final approval at the August 3, 2026 Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for August 3, 2026 at 11:00 a.m. Central Time in Division 20, Carnahan Courthouse, 1114 Market Street, St. Louis, MO 63101. The Court may move the hearing, so check EsseHealthSettlement.com for updates before traveling.

Where the money is going

This is a non-reversionary common fund. Attorneys' fees, service awards, and settlement administration costs come out of the $2,525,000 fund before the remaining money is divided pro rata among everyone who submits a valid Pro Rata Cash Payment claim. Medical Identity Protection is provided separately by Esse Health and is not paid out of this fund.

The Pro Rata Cash Payment is expected to be $50.00 per claimant but may be larger or smaller depending on the total number of valid claims filed.

Common questions

How much money will I receive?

The Pro Rata Cash Payment is expected to be $50.00 per Class Member, divided equally among everyone who submits a valid claim from whatever remains of the Settlement Fund after attorneys' fees, service awards, and administration costs. The actual amount could be higher or lower depending on how many people file. No proof or explanation is required to claim this payment.

Do I need to submit proof of purchase?

No. You do not need to provide any proof or explanation to claim the Pro Rata Cash Payment.

What if I didn’t receive a notice?

Esse Health's records were used to identify and notify Class Members directly by email or postcard, so most Class Members should have already received a notice with an enrollment code. If you believe your information was involved in the April 2025 Data Incident but did not receive a notice, contact the Settlement Administrator to confirm your Class Member status before the claim deadline.

Does staying in the class affect my right to sue later?

Yes. Unless you exclude yourself (opt out) by mailing a written Request for Exclusion postmarked by July 5, 2026, you will remain in the Settlement and will give up the right to sue, continue to sue, or be part of another lawsuit against Esse Health over the claims resolved by this Settlement. When will payments be sent out?

The Court will hold the Final Approval Hearing on August 3, 2026 at 11:00 a.m. Central Time. Medical Identity Protection activates once the Court grants final approval, and cash payments are issued after final approval and after any appeals are resolved. The appeal process can take a year or more. No action is required after a valid Claim Form is submitted.
