What happened
This lawsuit claims that Barefoot Dreams, Inc. disclosed its customers' personally identifiable information to third parties via the Meta Platforms, Inc. and Attentive Mobile Inc. tracking technologies and other tracking, analytics, and advertising technologies without consent. The complaint asserts claims under the Florida Security of Communications Act (Fla. Stat. § 934.03, et seq.), the federal Electronic Communications Privacy Act (18 U.S.C. § 2511, et seq.), the California Invasion of Privacy Act (Cal. Penal Code §§ 631 and 632), the Comprehensive Computer Data Access and Fraud Act (Cal. Penal Code § 502), and the California Constitution. The case is pending before the Honorable Michele Towbin Singer in the Circuit Court of the Seventeenth Judicial Circuit, Broward County, Florida.
Barefoot Dreams denies all of the claims in the lawsuit and maintains it did nothing wrong, but agreed to settle to avoid the expense, burden, and uncertainties of continued litigation. Under the Settlement, each Settlement Class Member who files a valid Claim Form will receive a cash payment of $8.00, subject to Court approval, and Barefoot Dreams will separately pay the costs of notice and administration, Class Counsel's attorneys' fees and costs, and service awards to the Class Representatives.

You must be a U.S. resident who purchased a product from www.barefootdreams.com or any of Barefoot Dreams' associated URLs between October 14, 2023 and through June 1, 2026.

2. Tally up your claim
Each Settlement Class Member who submits a valid Claim Form will receive a cash payment of $8.00, subject to Court approval. You must provide the Unique ID and PIN from the notice you received by email to verify your Settlement Class membership; if you did not receive this information, call the Settlement Administrator at 1-877-417-7449.

3. File online or by mail

4. Receive your payment
Payments are issued after the Court grants final approval at the August 17, 2026 Final Approval Hearing and any appeals are resolved. Payment is made electronically by PayPal, Venmo, or Zelle, or by check if you are unable to receive an electronic payment. Checks expire 180 days after they are issued.

The Final Approval Hearing is scheduled for August 17, 2026 in Courtroom WW-15170 at the Broward County Courthouse, 201 S.E. 6th Street, Fort Lauderdale, FL 33301, or by Zoom webinar. Where the money is going
The Notice does not disclose a total Settlement Fund amount. Barefoot Dreams pays a flat $8.00 cash payment to each Class Member who submits a valid and timely Claim Form, on a per-claim basis, and separately pays the costs of notice and administration, Class Counsel's attorneys' fees and costs, and the Class Representatives' service awards.
All amounts listed above are subject to final Court approval at the August 17, 2026 Final Approval Hearing. The Court may award less than the amounts requested. The Notice does not state a total Settlement Fund figure; contact the Settlement Administrator or Class Counsel with questions about the fund.

How much money will I receive?
Each Settlement Class Member who submits a valid and timely Claim Form will receive a cash payment of $8.00, subject to Court approval. The Notice does not disclose a total Settlement Fund amount. Class Counsel may seek up to one-third of the Settlement Fund for attorneys' fees and costs, paid separately from the $8.00 per-claimant payment.
Do I need to submit proof of purchase?
You must provide the Unique ID and PIN located on the notice you received by email when filing a claim. If you did not receive this information but believe you are a Settlement Class Member, call the Settlement Administrator at 1-877-417-7449 to verify your identity and get help filing a claim.
What if I didn’t receive a notice?
If you believe you are a Settlement Class Member but did not receive a notice email with your Unique ID and PIN, call the Settlement Administrator at 1-877-417-7449 for help verifying your identity and filing a claim.
Does staying in the class affect my right to sue later?
If you do not exclude yourself by July 31, 2026, you remain in the Class and give up your right to sue Barefoot Dreams for the claims resolved by this Settlement, whether or not you submit a Claim Form. To exclude yourself, mail a signed letter with your name, address, and a statement that you wish to be excluded, referencing Grubor, et al. v. Barefoot Dreams, Inc., Case No. CACE26003507, postmarked by July 31, 2026, to: Barefoot Dreams Privacy Settlement Administrator, PO Box 3127, Portland, OR 97208-3127.
When will payments be sent out?
The Court will hold the Final Approval Hearing on August 17, 2026 in Courtroom WW-15170 at the Broward County Courthouse in Fort Lauderdale, Florida, or by Zoom webinar. Payments will only be issued after the Court grants final approval and any appeals are resolved, and will be sent electronically by PayPal, Venmo, or Zelle, or by check if you select that option.
