What happened

This lawsuit, Butler v. Fairmont Federal Credit Union, claims that Fairmont Federal Credit Union, a West Virginia credit union, failed to adequately protect members' private information that was potentially impacted in a data security incident between September 30 and October 18, 2023. The case is pending in the United States District Court for the Northern District of West Virginia, and the settlement also resolves related actions filed in West Virginia state courts.

Fairmont Federal Credit Union denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation. As part of the settlement, the credit union also agreed to certain cybersecurity enhancements for five years.
